Removing 'bottlenecks', creating momentum for rapid and sustainable development

On the morning of January 16, in Hanoi , the Standing Committee of the Vietnam Fatherland Front Central Committee held a conference to orient a number of social criticism contents for the draft Law on Government Organization (amended); Law on Organization of Local Government (amended); Law on Promulgation of Legal Documents (amended).


The Conference was chaired by Professor, Dr. Tran Ngoc Duong, Chairman of the Advisory Council for Democracy and Law; Ms. Nguyen Quynh Lien, Head of the Committee for Democracy, Supervision and Social Criticism (Central Committee of the Vietnam Fatherland Front).

Comments at the Conference, experts and scientists unanimously agreed that these are three important draft laws that need to be focused on and completed to ensure consistency and synchronization with the policy of implementing the revolution in streamlining the apparatus of the political system from the Central to the grassroots level, in order to create momentum to bring the country into a new era - the era of national development.

Giving his opinion, Prof. Dr. Tran Ngoc Duong, Chairman of the Advisory Council for Democracy and Law, said that the draft Law on Government Organization (amended) and the Law on Organization of Local Government (amended) are closely related to each other. The amendment of these two important draft Laws aims to meet the goal of streamlining the apparatus to be streamlined, strong, efficient, effective and efficient.

On the basis of overcoming limitations, difficulties and inadequacies from practical implementation, fully concretizing the 2013 Constitution and institutionalizing policies and orientations in Party documents and Resolutions to continue promoting decentralization and delegation of power between central and local State agencies, ensuring the consistency and unity of the State administration.

Regarding the draft Law on Promulgation of Legal Documents (amended), Prof. Dr. Tran Ngoc Duong said that it is necessary to focus on removing "bottlenecks" in institutions, infrastructure and human resources to perfect the legal framework, towards building and operating a unified, synchronous, transparent, feasible, accessible, effective legal document system, unleashing all potentials and resources, creating new momentum for the country's rapid and sustainable development.

Dr. Nguyen Viet Chuc, Deputy Head of the Cultural and Social Advisory Council, also affirmed that the amendment of these three important draft laws is to meet the requirements of the apparatus streamlining revolution and the requirements of national digital transformation.

Raising the issue of needing to innovate thinking and the law-making process, Dr. Chuc suggested that the amendment of draft laws must aim to both ensure state management requirements and encourage creativity, liberate, and unleash all resources for development; resolutely abandon the mindset of "if you can't manage, ban" in law-making.

Along with that, the amendments to the three draft laws must aim towards strong decentralization and delegation of power, clearly defining the responsibilities of each entity, especially the leaders in each stage and process of policy making and drafting legal documents...

At the conference, many opinions also agreed that the amendment to the Law on Promulgation of Legal Documents must fully reflect the provisions and spirit of the 2013 Constitution, especially the mechanism of control, assignment, and coordination in the implementation of legislative, executive, and judicial powers; ensuring the rule of law in law-making and enforcement; on the legislative authority of the National Assembly, the rule-making authority of the Government, ministries, ministerial-level agencies, the authority to promulgate documents of local authorities within the scope of decentralization; on promoting democracy, strengthening the role of supervision and social criticism of the Vietnam Fatherland Front in law-making and enforcement.

In the Law on Organization of Local Government (amended), the opinions suggest that the principle of promoting decentralization must be expressed and clarified in the direction of "locality decides, locality does, locality is responsible", "clear work, clear people, clear responsibilities". Clearly defining the tasks and powers of local governments at all levels will contribute to building a unified, transparent, professional, and modern state administration.

Receiving opinions at the Conference, Ms. Nguyen Quynh Lien, Head of the Committee for Democracy, Supervision and Social Criticism (Central Committee of the Vietnam Fatherland Front) said that after this conference, on January 20, the Standing Committee of the Central Committee of the Vietnam Fatherland Front will organize a Conference on social criticism of the draft Law on Government Organization (amended); Law on Organization of Local Government (amended); Law on Promulgation of Legal Documents (amended). The conference on criticism of these 3 important draft Laws will be connected online from the central bridge point of the headquarters of the Central Committee of the Vietnam Fatherland Front to 63 local bridges.
