Removing obstacles in the Bac Cau Bang urban area project

For nearly 20 years, hundreds of households have contributed capital to buy land for the project to invest in the construction and business of infrastructure for the new urban residential area north of Bang bridge (Bang bridge project) in Thong Nhat commune and have had to live in a state of weary waiting. The project was approved a long time ago, but until now it has been "shelved", with no progress. People have repeatedly petitioned the authorities to remove the obstacles, but they have not been resolved.

People who contributed capital to the Bang Bridge project have not yet received land.

In 2003, the Bang Bridge project was approved by the Provincial People's Committee for location, and assigned as investor to Construction and Infrastructure Business Enterprise 707, under Construction Company 507 (Transportation Construction Corporation 5). By 2005, the project's investor was changed to Thong Nhat 508 Joint Stock Company (Transportation Construction Corporation 5). According to the plan, the project has a total area of 134 hectares, mainly aquaculture land, agricultural land, tiger prawn fields and about 16 hectares of residential land of 34 households in Chan Deo village, Thong Nhat commune. The project is divided into 2 phases with a total investment of 418 billion VND.

On January 11, 2008, Thong Nhat 508 Joint Stock Company was handed over the first phase of land with nearly 472,000m2 to implement the project, with a duration of 3 years. However, up to now, the investor has only leveled the ground, paved the ground with stone, poured concrete on some internal roads in the planning; installed the electrical system on the main road... Other items such as the surface drainage system, wastewater treatment... have not been implemented yet.

For the area that has not been allocated land, the investor has completed land clearance of more than 62 hectares; leveled and filled the ground reaching 50% of the volume, and built internal traffic roads reaching 20%. The remaining 15.7 hectares have not been cleared, and have been recovered to issue land use right certificates to households in Chan Deo village. Thus, up to now, the project has been behind schedule for more than 15 years since the date of land handover on site.

A project that was expected to turn an area of mainly aquaculture ponds, agricultural land, mangrove swamps... into a new urban area, bringing a breakthrough to the local face. However, up to now, the project has been at a standstill, and those who contributed capital have not yet received land even though they have fulfilled all financial obligations. At that time, capital contribution was the only form applied for people to buy land in projects in the province, as well as many other provinces and cities in the country. In fact, there have been tens of thousands of cases where people bought land in the form of capital contribution and were granted land use right certificates and lived stably for many years.

Phase 2 of the Bang Bridge project has now been terminated.

According to the capital contribution contract of this project, customers will receive land use transfer and land handover in the fourth quarter of 2008-2012. In particular, for phase 2 of the project, on January 17, 2018, the Department of Planning and Investment issued Decision No. 121/QD-KHDT on terminating phase 2 for the reason: The project was terminated due to slow progress (9 years late) and failure to pay land use fees to the State. This made the households who contributed capital extremely worried.

Ms. Ngo Thi Quynh Hoa (Ha Long ward) said: I am one of 500 customers who have contributed capital to the investor since 2007, but for nearly 20 years now I have not known where my land is. I hope that the authorities at all levels and functional agencies will consider removing difficulties and ensuring the rights of the people.

In response to the people's concerns, the Customer Representative Board (those who have contributed capital to the project) proposed to continue to coordinate the implementation of the project. Specifically, Thong Nhat 508 Joint Stock Company and the Customer Representative Board committed to implementing the project under the close supervision of the Provincial People's Committee, following the model of the Don Dien New Urban Residential Area Project (now in Tuan Chau Ward) which had previously brought about results. Ms. Nghiem Thi Thuy, Director of IDJLAND Joint Stock Company (Customer Representative Board) said: If approved, we will promptly complete our financial obligations, pay land use fees and related costs, and strictly comply with the direction of the Provincial People's Committee, regularly report on the progress of the project so that it can be implemented soon.

Nearly 20 years of waiting is too long for a project that was once expected to change the face of the local urban area. Hundreds of households that contributed capital are suffering great losses, while their rights are still being neglected. It is time for the government and investors to have a definitive, transparent solution to ensure fairness for the people.
