Through the Law amending and supplementing a number of articles of the Law on National Defense and Security Industry and Industrial Mobilization

Continuing the agenda of the Tenth Session, on the morning of December 10th, under the chairmanship of National Assembly Chairman Tran Thanh Man and the direction of National Assembly Vice Chairman, Lieutenant General Tran Quang Phuong, the National Assembly voted to approve the Law amending and supplementing a number of articles of the Law on National Defense and Security Industry and Industrial Mobilization with 434 out of 436 National Assembly deputies present voting in favor, reaching 99.54%.

The Law amending and supplementing a number of articles of the Law on National Defense, Security and Industrial Mobilization consists of 2 articles, effective from January 1, 2026; the provisions in Clauses 1, 2, 3 and 4 of Article 1 are effective from March 1, 2026.

According to the Law, the national defense industry plan and the national security industry plan are sectoral plans; they are prepared, appraised, approved, published, and adjusted in accordance with the provisions of this Law, the law on planning, and the law on protecting state secrets.

Priority should be given to allocating resources in the five-year financial plan and annual state budget estimates for defense and security production tasks of core defense industry facilities and core security industry facilities, based on the state budget's balancing capacity.

The law stipulates that the National Defense Industry Fund is a non-budgetary state financial fund, established at the central level and managed by the Ministry of National Defense , to invest in and support the implementation of innovative, high-risk tasks, programs, projects, and activities that accept risks, venture capital, or research, design, and manufacture of weapons and technical equipment to develop the national defense industry.

The Security Industry Development Investment Fund is a non-budgetary state financial fund established at the central level and managed by the Ministry of Public Security to invest in and support the implementation of programs, projects, and activities, accepting risks and making venture investments to develop the security industry.

The National Defense Industry Fund and the National Security Industry Development Investment Fund are formed from the following financial sources: Support from the state budget; Legitimate capital sources decided by competent authorities; Funds allocated from after-tax profits as stipulated in point a, clause 4, Article 21 of the Law; Voluntary contributions from domestic and foreign organizations and individuals; Contributions from other components of the national defense industry complex to the National Defense Industry Fund, and contributions from members participating in the national security industry complex to the National Security Industry Development Investment Fund; and other legitimate financial sources as prescribed by law.

Sources include the Defense Industry Fund, the Security Industry Development Investment Fund, and other legitimate funds allocated to the defense and security industry.

Core defense industry bases establish a Defense Industry Fund, and core security industry bases establish a Security Industry Development Investment Fund.

The national security industry complex is led and directed by the State, with core security industrial facilities as its nucleus, and involves the participation of organizations and enterprises inside and outside the People's Public Security with resources and scientific and technological potential to organize and implement tasks in building and developing the security industry.

The components of the national security industrial complex include: the core of the national security industrial complex, which is the core security industrial base; and the members participating in the national security industrial complex, which include organizations and enterprises inside and outside the People's Public Security.

The Prime Minister decides that the core security industry is the nucleus of the national security industry complex. The Minister of Public Security decides on the members participating in the national security industry complex.
