The White House announced on February 17 that billionaire Elon Musk is not a member of the U.S. Department of Government Effectiveness (DOGE) and does not have decision-making authority.
According to court documents filed by the White House, Elon Musk only acted as an advisor to U.S. President Donald Trump and conveyed the president's instructions, Reuters reported.
"Like any other senior White House adviser, Mr. Musk does not have the authority to make decisions on behalf of the government," according to a filing submitted by U.S. Government Office Director Joshua Fisher.

Judge Tanya Chutkan, who will preside over the February 18 hearing concerning questions about Musk's authority, has expressed concerns about the unpredictable nature of DOGE's operations.
“DOGE appears to be operating in a disorderly manner. This is essentially a private sector citizen running a non-federal agency with access to federal government operations, able to fire, hire, terminate contracts or programs without congressional oversight,” ABC News quoted Tanya Chutkan as saying.
