Ho Chi Minh City removes obstacles in compensation and resettlement work

Accordingly, regarding the determination of specific land prices, the 2024 Land Law stipulates that the authority belongs to the Chairman of the District People's Committee. However, this authority has now been delegated to the Chairman of the Commune People's Committee. In reality, many projects have land acquisition scopes related to two or more communes, causing difficulties when hiring consultants to determine land prices in border areas.

To resolve the issue, the Ho Chi Minh City People's Committee assigned the Department of Natural Resources and Environment to preside over hiring a consulting unit to determine the general land price for the entire project, after which the Chairman of the Commune People's Committee will approve the compensation plan, ensuring consistency and suitability to reality.

Regarding the project of dredging Xuyen Tam canal (formerly Binh Thanh and Go Vap districts) and improving the environment of the North bank of Doi canal (formerly District 8), currently according to Decree 151/2025/ND-CP, the authority to decide on resettlement measures and support levels belongs to the People's Committee at the ward level. However, to ensure consistency and uniformity, the City agrees to continue applying the previously issued regulations in implementing compensation and resettlement support for these two projects.

In addition, for projects that have been approved for investment before July 1, 2025 and have implemented a part of the land area, the People's Committee of Ho Chi Minh City allows the continued application of the old regulations on land recovery, compensation, support, and resettlement of the People's Committees of localities before the administrative merger (Ho Chi Minh City, Binh Duong, Ba Ria - Vung Tau ). This is to avoid interruption of progress and ensure the disbursement rate of public investment capital, especially the capital for compensation work.

The Ho Chi Minh City People's Committee requested heads of relevant departments, branches, and units, along with Chairmen of People's Committees of communes, wards, and special economic zones with projects to urgently implement them in accordance with Plan 1451/KH-UBND dated March 6, 2025, ensuring the progress of disbursement of public investment capital in 2025.
