Submit to the National Assembly to amend and supplement 5 laws in the fields of finance and trade

On the morning of November 3, the National Assembly listened to the Presentation and Verification Report on the following projects: Law amending and supplementing a number of articles of the Law on Public Debt Management; Law amending and supplementing a number of articles of the Law on Insurance Business; Law amending and supplementing a number of articles of the Law on Statistics; Law amending and supplementing a number of articles of the Law on Prices; Law on E-commerce.

Ensure effective management of capital mobilization and use

Draft Law amending and supplementing a number of articles of the Law on Public Debt Management amends and supplements the content of 23/63 articles of the current Law.

To continue implementing the policy of decentralization and delegation of power, associated with the arrangement and streamlining of the organizational apparatus, and improving the effectiveness of governance, the draft Law has stipulated the empowerment of the Prime Minister and the Ministry of Finance in a number of tasks related to debt management, enhancing the initiative and self-responsibility of local authorities in deciding and using the budget. Accordingly, it supplements clearer regulations on the tasks and powers of the President and the Government, amends and supplements the powers and tasks of the Prime Minister and the Ministry of Finance. Specifically, the draft Law completes the contents related to the authority of the President, the Government and the Prime Minister in negotiating, signing, approving, ratifying and amending, supplementing and extending international treaties in the name of the State and in the name of the Government on ODA loans and foreign preferential loans; clearly stipulates the process and procedures for negotiating, signing, amending, supplementing and extending international treaties on ODA loans and foreign preferential loans.

The Draft Law removes the provision in Clause 4, Article 13, decentralizes the Prime Minister to approve the loan limit for re-lending and the Government guarantee limit associated with the approval of the annual public borrowing and debt repayment plan to shorten procedures; assigns the Ministry of Finance to proactively manage and publish documents submitting the annual public borrowing and debt repayment plan to meet the publicity requirements according to international practices.

Examining the draft Law, the National Assembly's Economic and Financial Committee requested the Drafting Agency to continue reviewing to ensure consistency with the provisions of the State Budget Law, the Law on International Treaties, the Law on Credit Institutions and related regulations.

The examining body basically agrees with the draft Law amending and supplementing a number of contents related to the decentralization of authority for the Prime Minister to decide on the loan limit for re-lending and the annual Government guarantee limit associated with the approval of the Public Debt Loan and Repayment Plan; adding tasks of the Ministry of Finance to ensure flexibility in the implementation process and reduce administrative procedures. In addition, the examining body recommends that the Government continue to review to ensure that the decentralization and delegation of authority regulations go hand in hand with increased objectivity, transparency and ensuring effective management of loan mobilization and use.

Cut and simplify insurance business conditions

Compared to the current Law on Insurance Business, the draft Law submitted to the National Assembly at the 10th Session amends 25 articles. In particular, the draft Law reduces and simplifies business conditions in 7 articles: abolishing the confirmation of foreign management agencies that enterprises do not seriously violate regulations; abolishing conditions before officially operating; removing a number of general conditions and standards for managers and controllers; removing a number of conditions for insurance agency activities, licensing the establishment and operation of brokerage enterprises and providing insurance auxiliary services.

Regarding the content of amendments and improvements, the draft Law removes a number of other difficulties and obstacles for businesses in 6 articles: amending the content of activities of non-life and health insurance businesses to avoid confusion; changing the names of branches and representative offices; loosening the principles of holding positions; removing the regulation on notifying the Ministry of Finance after publicizing information; expanding the scope of activities of insurance agents; extending the time for converting insurance agent certificates; allowing transition for member companies of insurance enterprises.

One of the important contents raised in the examination by the Economic and Financial Committee is to emphasize the need to balance between creating conditions for market development and ensuring tight control of system safety, especially in the context of complicated developments in the insurance market.

Regarding the principles of enterprise management and legal consistency, the Committee proposed a comprehensive review of regulations on organizations and individuals participating in capital contribution, establishment, management and control of enterprises, to ensure comprehensiveness and consistency with the Enterprise Law. The examining agency requested clarification of the legal and practical basis for adding regulations on "control of insurance enterprises", carefully considering the necessity of replacing the regulations being referred to under the current Enterprise Law with a general regulation. The abolition of business conditions must be accompanied by effective alternative solutions to screen the reputation and capacity of foreign organizations participating in the market.

Minister of Finance Nguyen Van Thang stated that the development of the Law amending and supplementing a number of articles of the Law on Statistics aims to create a legal corridor for statistical activities; provide accurate, objective, timely statistical information, correctly and fully reflecting the socio-economic situation in each period; help analyze, plan and operate macro policies and ensure international comparison requirements in all fields.

The Draft Law focuses on amending the following contents: Group of regulations related to the arrangement of the state apparatus and state statistical organizations, organization of two-level local governments; Group of regulations related to specialized statistical inspection and specialized statistical inspection; Group related to statistical expertise and profession arising in practice; Group of regulations related to the application of statistical methods, information technology and digital transformation in state statistical activities.

Chairman of the National Assembly's Economic and Financial Committee Phan Van Mai said that the Committee agreed with the necessity and scope of amending and supplementing a number of articles of the Law on Statistics; requested the drafting agency to carefully review to ensure feasibility, suitability with the characteristics of the agency performing statistical tasks at the commune level, and suitability with the capacity and staffing of the commune level.

The draft Law adjusts the Prime Minister's authority to the Minister of Finance in deciding to conduct a national statistical census; decentralizes the authority to the Minister, Chief Justice of the Supreme People's Court, Supreme People's Procuracy... to adjust and supplement the assigned national statistical census. The Economic and Financial Committee finds that the adjustment of authority to promote decentralization in the field of statistics is appropriate; therefore, it basically agrees with the draft Law.

Implement the roadmap to correctly and fully calculate public service prices

According to the Government's Submission on the draft Law amending and supplementing a number of articles of the Law on Prices, the draft Law amending the provisions on transferring the responsibility for implementing price stabilization from the People's Committee at the district level (as assigned by the People's Committee at the provincial level) to the People's Committee at the commune level; amending the names of a number of goods and services priced by the State and the authority and form of pricing; amending and supplementing the provisions on specialized price inspection to be consistent with the law on inspection; amending and supplementing the names of ministries and branches associated with the authority to manage the State on prices that have been changed due to the reorganization of the State apparatus... The draft Law also supplements a number of contents on infrastructure services of industrial parks, economic zones, concentrated digital technology parks, high-tech parks and industrial clusters invested from the State budget.

Regarding decentralization, the draft Law continues to implement the policy of strengthening decentralization to ensure the roadmap for correct and adequate calculation of public service prices; enhance proactiveness, and ensure flexible and timely adjustments by localities and units.

Chairman of the Economic and Financial Committee Phan Van Mai stated: Regarding the list of goods and services whose prices are determined by the State (Clause 4, Article 1), the Committee basically agrees with the provisions of the draft Law to ensure consistency with relevant legal provisions and in line with the policy of promoting decentralization and delegation of power. However, regarding the list related to the civil aviation sector, the Committee requested the drafting agency to continue reviewing and ensuring consistency with the Law on Civil Aviation (amended) to avoid difficulties in implementation.

The draft Law adds infrastructure services in industrial parks, economic zones, concentrated digital technology zones, high-tech zones and industrial clusters invested from the State budget to the List of goods and services whose prices are determined by the State and whose pricing authority is determined by the Provincial People's Committee. The majority of opinions in the Committee basically agree with the draft Law, which assigns pricing authority to the Provincial People's Committee to determine specific prices to reduce administrative procedures and ensure consistency and unity in the management and exploitation of investment assets from the State budget.

Clearly define livestream sales and affiliate marketing activities

This morning, the National Assembly also heard the Presentation and Review Report on the draft Law on E-commerce.

Presenting the Proposal, Minister of Industry and Trade Nguyen Hong Dien stated that the draft Law is designed to include 7 chapters and 48 articles.

Regarding the types and responsibilities of entities participating in e-commerce activities, the draft Law stipulates four models of e-commerce activities, including: direct business e-commerce platforms; intermediary e-commerce platforms; social networks operating e-commerce; and multi-service integration platforms.

Notably, for livestream sales activities, the draft Law clearly stipulates that the platform owner must authenticate the identity of the livestreamer, publicize and implement mechanisms and measures to control livestream sales content in real time. For sellers, they are responsible for providing livestreamers with legal documents proving that they meet the conditions.

Presenting a summary of the Audit Report, Chairman of the Economic and Financial Committee Phan Van Mai proposed to review and clarify the scope of responsibility of the owner determined on the basis of having the function of online ordering, livestream sales associated with ordering through the online ordering function on the platform or having the feature of supporting payment services, logistics services (including the form of support integrated with the online communication function) on the platform to have regulations at an appropriate level.

Regarding livestream sales and affiliate marketing activities (Articles 20 to 24), the inspection agency proposed clearer regulations on the aspects of this activity that are specifically regulated by the Law on E-commerce, distinguishing them from general contents regulated by the Law on Network Information Security, Law on Cyber ​​Security, Law on Advertising, and Law on Consumer Rights Protection.
