The Central Inspection Commission was increased by 4 members with a total membership of 23 to 25 members, of which no more than 1/3 are members of the Party Central Committee.

General Secretary To Lam has signed and promulgated Regulation 262 amending and supplementing a number of articles in Regulation No. 22/2021 of the Central Committee of the Party on inspection, supervision and disciplinary work of the Party.

One of the notable aspects of Regulation 262 is the amendment and supplementation of regulations on the organizational structure and number of members of inspection committees at all levels.

According to Regulation 262, the Central Inspection Committee has 23 to 25 members (including 2 to 3 members holding concurrent positions), of which no more than one-third are members of the Central Committee of the Party. Compared to Regulation 22/2021, the new regulation increases the number of full-time members by 4.

The new regulations also state that the Standing Committee of the Central Inspection Commission consists of a chairman and vice-chairmen; the number of vice-chairmen is decided by the Politburo.

Regulation 262 also omits the regulations on the Party Disciplinary Committee of the Party Committees of the Central Government agencies and the Central enterprises, and adds regulations on the Party Disciplinary Committees of the Party Committees of the Central Party agencies, the Government Party Committee, the National Assembly Party Committee, and the Party Committees of the Vietnam Fatherland Front and central mass organizations.

The Inspection Committees of these agencies have 9 to 11 members. The Inspection Committee of the Government Party Committee, however, has 11 to 13 members, including some part-time and full-time members, with the chairman of the Inspection Committee being a deputy secretary or a member of the Standing Committee of the Party Committee.

The scope of control includes the assets and income of both the official's spouse.

Another notable aspect of Regulation 262 is the addition of provisions regarding the performance of duties related to asset and income control.

Accordingly, the subjects of asset and income control for Party members are officials under the management of the Standing Committee of the Party Committee at the same level (excluding the secretary and deputy secretary at the same level) and Party members who are obligated to declare assets and income while working in Party agencies at the same level and lower levels as prescribed.

The scope of oversight includes the assets and income declared by Party members and those of individuals with rights and obligations related to the assets and income of Party members (spouse, minor children).

Regarding the authority to control assets and income, the inspection committee of the Party committee at the district level and above has the authority to decide on verifying the assets and income of Party members under the management of the Standing Committee of the Party committee at the same level, and Party members who are obligated to declare assets and income while working in Party agencies at the same level and below, as prescribed.

This agency verifies the accuracy, completeness, and clarity of asset and income declarations; the origin and changes in assets and income of party members and those with related rights and obligations (spouse, minor children of party members).

Simultaneously, conclusions will be drawn regarding the honesty, completeness, and clarity of the asset and income declarations, as well as the origin and changes in assets and income...

The new regulations also amend a provision regarding the validity of disciplinary decisions. Specifically, disciplinary decisions and decisions resolving disciplinary appeals against violating Party organizations or Party members must be delivered to the violating Party organization and Party member for compliance. If broader notification is necessary, it will be decided by the Party committee or Party organization with the authority to discipline the Party member.

The authority and responsibility for resolving disciplinary appeals have also been revised and supplemented. Specifically, for disciplinary measures decided by the Central Committee, the Politburo, the Secretariat, and the Central Inspection Commission, the Central Committee is the final level for resolving appeals.

Regarding the procedure for suspending party membership, Regulation 262, as amended and supplemented, stipulates special cases. For cases under investigation, inspection, or audit where a party member is found to have signs of personal responsibility or serious violations, and remaining in office would hinder the review and conclusion, in addition to suspending party membership or suspending the party committee, the competent party organization may decide to suspend the party member from the position they currently hold.

At the same time, the Party committee responsible for managing that Party member is tasked with directing state organizations, the Fatherland Front, and socio-political organizations to decide on suspending their government and organizational positions according to their authority.
