NDO - The Ministry of Education and Training maintains the stance that "information about misconduct by teachers should not be publicly disclosed before an official conclusion is reached by the competent authority" in the Draft Law on Teachers.
Taking into account feedback and criticism, the Ministry of Education and Training has made some adjustments to the Draft Law on Teachers.
Besides clarifying what teachers are prohibited from doing, the draft Law on Teachers also stipulates what organizations and individuals are prohibited from doing to teachers, such as: Failing to fully implement the regulations and policies for teachers as prescribed; publicly disclosing information about teachers' misconduct before an official conclusion is reached by the competent authority during the process of considering disciplinary action or legal prosecution against the teacher, etc.
"There are concerns about the regulation prohibiting 'public disclosure of information about teachers' misconduct before an official conclusion is reached by the competent authority during the disciplinary review or legal prosecution process,' arguing that this regulation conflicts with regulations on information, speech, and 'defending' teachers. However, this regulation is necessary to protect teachers, especially in the context of the strong development of social media and online communication tools today. Teachers who commit misconduct are already subject to sanctions according to regulations," the Ministry of Education and Training explained.
According to the Ministry of Education and Training, the professional activities of teachers are unique in nature; without measures to protect teachers, the affected parties will not only be teachers but also students.
The Ministry of Education and Training's proposal not to "publicly disclose information about teacher misconduct until an official conclusion is reached" has met with both support and opposition. Teachers, as civil servants and public employees, like other citizens and groups in society, are subject to legal oversight and criticism when misconduct occurs.
