The Ministry of Education and Training maintains a limited stance on "publicizing teachers' violations"

NDO - The Ministry of Education and Training maintains the view that it is not allowed to "Publicize information about teachers' violations without an official conclusion from a competent authority" in the Draft Law on Teachers.

In response to comments and criticism, the Ministryof Education and Training has made some adjustments to the Draft Law on Teachers.

In addition to more clearly defining what teachers are not allowed to do, the draft Law on Teachers stipulates what organizations and individuals are not allowed to do towards teachers, such as: Not fully implementing the regime and policies of teachers as prescribed; Publicizing information about teachers' violations when there is no official conclusion from the competent authority during the process of considering discipline or prosecuting legal responsibility for teachers, etc.

“There are concerns about the regulation that “Information about teachers’ violations cannot be made public without an official conclusion from a competent authority in the process of considering discipline or prosecuting teachers’ legal liability” because it is believed that this regulation will be entangled with regulations on information, speech and “defending” teachers. However, this regulation is necessary to protect teachers, especially in the context of strong development of social networks and online media as it is today. If teachers commit violations, there will be sanctions to handle them according to regulations” – the Ministry of Education and Training explained.

According to the Ministry of Education and Training, the characteristics of teachers' professional activities are special. If there is no plan to protect teachers, the affected subjects will not only be teachers but also students.

The proposal of the Ministry of Education and Training not to “publicize information about teacher violations until there is an official conclusion” has also met with opposition, in addition to consensus opinions. Accordingly, teachers are civil servants, public employees, and like other citizens and groups in society, are subject to supervision and criticism in legal ways when there are violations.
