
According to statistics, Hanoi , Ho Chi Minh City, and Nghe An province currently have the highest number of requests for criminal record certificates nationwide.
From 2021 to 2023, on average, Hanoi issued 51,211 criminal record certificates, Ho Chi Minh City issued 95,979 criminal record certificates, and Nghe An province issued 56,900 criminal record certificates annually.
"Given the limited human resources, equipment, and facilities of the Department of Justice, receiving a large number of applications has overloaded the criminal record check departments in these localities. At times, people have to queue up very early to submit applications for criminal record certificates, causing public dissatisfaction," according to the Ministry of Justice .
The Ministry of Justice believes that the pilot program to decentralize the issuance of criminal record certificates to district-level administrative units in Hanoi, Ho Chi Minh City, and Nghe An province is extremely necessary at this time. It contributes to reducing the direct pressure on the Department of Justice in handling criminal record certificate issuance procedures, as well as making it more convenient for citizens to go to district-level justice offices to complete the procedures, and increasing the proactive role of district-level administrative units in handling administrative procedures.
The Ministry of Justice proposed a pilot period of two years for this policy, which is sufficient time for localities to prepare the resources for implementation, and also enough time for preliminary and final reviews before proposing amendments to the law for nationwide application.
Based on the above grounds, the Ministry of Justice submits to the Government a proposal to develop a Resolution of the National Assembly to pilot the decentralization of the issuance of criminal record certificates to a number of justice departments under the People's Committees of districts in Hanoi, Ho Chi Minh City, and Nghe An province.
Currently, Hanoi has 30 district-level administrative units; Ho Chi Minh City has 22 district-level administrative units; and Nghe An province has 21 district-level administrative units.
It is known that the Department of Justice has 3 civil servants (1 department head (concurrently), 1 head of the administrative justice division (concurrently), and 1 specialist in the administrative justice division) and 4 contract employees to carry out the work of issuing criminal record certificates.
At the Provincial Public Administrative Service Center, two civil servants are assigned to receive applications for criminal record certificates, and one civil servant is responsible for delivering the results of the criminal record certificate issuance.
The Department of Justice has fully equipped itself with the necessary facilities and resources to support the issuance of criminal record certificates; ensuring that the process of receiving, digitizing files, sending and receiving results of criminal record verification, processing files, and digitizing the results of issuing criminal record certificates is carried out seamlessly on the software systems of the Ministry of Justice and the province.
From October 2nd, 2020, the acceptance of applications and the issuance of criminal record certificates will be carried out at the Provincial Public Administrative Service Center; citizens, agencies, and organizations applying for criminal record certificates can choose to submit their applications directly or via public postal service to the Nghe An Provincial Public Administrative Service Center, or submit their applications through the province's Level 4 online public service portal.
From January 1, 2021 to October 30, 2023, the Nghe An Department of Justice received 171,041 applications for criminal record certificates. The number of applications has continuously increased over the years (34,189 applications in 2021; 67,390 applications in 2022; and 69,462 applications in the first 10 months of 2023). The majority of people submitted their applications in person, while the rest were submitted via postal service and online.
