The case file regarding the Quang Son Cement Plant project, which incurred losses of thousands of billions of dong, has been transferred to the investigative agency.

On December 11th, the Government Inspectorate issued a notice summarizing the conclusions of a comprehensive inspection of the proposal, implementation, and business operations of the Quang Son Cement Plant Project.

According to the Government Inspectorate , the Quang Son Cement Plant Project is being built in the former Dong Hy and Vo Nhai districts of Thai Nguyen province, which are mountainous areas with a majority of ethnic minority populations facing significant difficulties, low levels of education, and poor living standards; infrastructure is also underdeveloped.

The project, once operational, will facilitate the development of local and regional industries, increase local revenue, create more jobs for the children of ethnic minorities in the region, contribute to the restructuring of the local economy , and improve the lives of the people, especially ethnic minorities…

"However, the project's business performance as of December 31, 2021 showed a loss of more than 1.9 trillion VND," the inspection report concluded.

According to the inspection report, Vinaincon Corporation's approval of adjustments exceeding the total investment amount was beyond its authority, contrary to regulations, violated the Bidding Law and the Construction Law, and went against the Prime Minister 's directives, potentially causing losses exceeding 1,000 billion VND; it also illegally profited over 46 billion VND from resource exploration and exploitation.

Based on the records, documents, and verification results, the Government Inspectorate believes that the implementation of the project shows signs of violating regulations on bidding causing serious consequences according to Article 222; signs of violating regulations on investment in construction projects causing serious consequences according to Article 224; and the crime of negligence causing serious consequences according to Article 360 ​​of the 2015 Penal Code (amended and supplemented in 2017) in bidding packages No. 01, 02, and 03.

Specifically, the bidding plan for package number 01 was approved without proper authority; the bid price was nearly 18 million USD (equivalent to 322 billion VND) higher than the plan, yet the bid was still awarded. The inspection revealed that the contract included some quantities of goods supplied lower than required by the tender documents, but the contract price was not reduced, potentially resulting in a loss of nearly 4 million Euros (equivalent to 79 billion VND as of September 9, 2005). The total cost of expert supervision exceeded 1.3 million Euros (equivalent to over 34.5 billion VND as of December 31, 2014).

Regarding packages 02 and 03, the Government Inspectorate pointed out that Vinaincon and Quang Son Cement Company Limited did not purchase equipment and machinery themselves for mining but instead leased them to Quang Son Limestone Mining Joint Stock Company, which was not in accordance with the plan approved by the Prime Minister. In 2008, Vinaincon did not organize a tender to select a contractor for mining, loading, and transporting limestone and clay for Quang Son Cement Plant; in 2023, it organized a tender with a winning bid of 47.5 billion VND, potentially causing a loss of this amount. In addition, the enterprise also illegally mined more than 806,000 tons of stone, selling it on the market as construction stone, earning nearly 47 billion VND in illicit profits.

The Government Inspectorate also forwarded information to the Ministry of Public Security, instructing relevant agencies to verify several consulting and construction contracts under packages 32A, 13, 14, and 19.

Other irregularities totaling nearly 364 billion VND, stemming from Vinaincon's over-adjustment of the total investment without proper authority and without permission to adjust for inflation adjustments as stipulated by law, potentially causing losses, were also recommended for clarification by the Government Inspectorate.

The Inspector General of the Government has recommended that the Prime Minister instruct the Ministry of Public Security to receive the case files and documents transferred from the inspection agency for processing in accordance with the law.

The Ministry of Industry and Trade, the Ministry of Finance, and several related ministries, along with the People's Committee of Thai Nguyen province, are conducting a review of collective and individual responsibilities over various periods in fulfilling assigned duties and responsibilities, providing advice and recommendations, and failing to conduct proper inspections that led to shortcomings and violations.

The Government Inspectorate stated: "During the implementation process, if any signs of legal violations are detected, they will be transferred to the investigating agency for handling in accordance with the law."
