(Dân trí) - Một số ĐBQH đề nghị có biện pháp ràng buộc các nền tảng xuyên biên giới trả phí bản quyền, chia sẻ doanh thu với báo chí. Dự thảo Luật Báo chí sửa đổi đã tiếp thu và bổ sung quy định về nội dung này.

On the morning of December 4, the National Assembly Standing Committee gave opinions on explaining, accepting and revising the draft Press Law (amended).

Reporting on a number of major issues in receiving, explaining and revising the draft Press Law (amended), the Standing Committee of the Culture and Social Affairs Committee (the examining body) said that some opinions suggested the need for legally binding measures to require cross-border platforms (such as Google, Facebook, TikTok...) to pay copyright fees and share revenue with Vietnamese press agencies; clarify the responsibility of social networking platforms in preventing and handling toxic information, fake news and false news on their platforms.

At the same time, there are opinions suggesting that the protection of press copyright in cyberspace needs to be regulated more specifically to avoid illegal copying, which is widespread on social networks, which is greatly affecting copyright and information transparency.

Accepting this opinion, the Standing Committee of the Committee said that to ensure copyright and related rights, the draft Law has added Clause 2, Article 39, which stipulates: agencies, organizations and individuals using press works must reach an agreement with the press agency according to the provisions of law.

The review agency determined that information posted by cross-border platforms is not within the scope of the draft Law. The handling of this information is regulated in Decree No. 147 of the Government on management, provision and use of Internet services and online information. Accordingly, cross-border platforms must remove infringing information within 24 hours of receiving a request from a Vietnamese agency.

Regarding the State's policy on press development, some opinions say that there should be preferential tax policies and financial support for the press to carry out political and public service tasks and for investing in digital technology in modern press activities.

In response to comments from National Assembly deputies, the Standing Committee and the drafting agency have revised the draft Law in the direction of adding provisions that the State has tax incentive policies in accordance with the law.

Tax incentives for the press are stipulated in the Law on Corporate Income Tax, according to which, the press enjoys a tax rate of 10%. Previously, only printed press enjoyed a tax rate of 10%, other types of press were subject to a tax rate of 20%.

Regarding financial support for the press to carry out political and public service tasks, the draft Law stipulates that the State has policies to assign tasks, place orders, bid, and support transportation costs, publishing, transmission, and broadcasting costs for the press to serve political, security, national defense, and cultural tasks, etc.

Some opinions suggested piloting the model of a multi-media press group or consortium in Hanoi and Ho Chi Minh City. The review agency also accepted and said that the Ministry of Culture, Sports and Tourism summarized the Press Development and Management Plan, and planned to propose that competent authorities continue to implement some of the Plan's viewpoints and add new viewpoints, including the content that Hanoi and Ho Chi Minh City are allowed to establish multi-media press agencies.

Based on the direction and approval of competent authorities, the Ministry of Culture, Sports and Tourism will specify these contents in the Strategy for development and management of the press system, ensuring feasibility, consistency and conformity with the national press development orientation.

The National Assembly Chairman noted that this time the Press Law is amended in the spirit of implementing a revolution in the arrangement of the apparatus and organization of two-level local governments, so the Vietnam Fatherland Front and organizations must arrange press units.

The National Assembly Chairman also agreed to amend regulations on press support and tax incentives for the press in the direction that all types of press enjoy a common tax rate of 10%.

To ensure copyright, the National Assembly Chairman approved the draft law supplementing regulations that agencies, organizations and individuals using press works must reach agreements with the press in accordance with the law.
