Proposal to expand the scope of verification to prevent the dissipation of corrupt assets

National Assembly delegates proposed verifying assets of relatives of corrupt criminals to avoid dispersal, ensuring both deterrence and improving the effectiveness of asset recovery.

On the morning of November 5, the National Assembly discussed in groups a number of draft laws, including the law amending and supplementing a number of articles of the Law on Anti-Corruption.

According to current regulations, the selection of people to verify assets and income is done randomly, by drawing lots or using computer software.

The number of selected people must ensure at least 10% of the number of people required to make annual declarations at each verified agency, organization or unit, of which at least 1 person is the head or deputy head.

Expanding verification scope to prevent asset dissipation

Delegate Hoang Van Cuong (Hanoi delegation) said that the drawing of lots to verify assets is no longer appropriate. He proposed a "rigid regulation" that the number of assets that need to be verified annually is 20%, then rotated so that "everyone must verify". Thus, asset verification will be a very normal thing, "there is nothing wrong with it".

Regarding this issue, voters also proposed to abolish the random drawing method. In response at that time, the Government Inspectorate said that it was compiling reports and considering recommendations from ministries, branches and localities on problems and difficulties in the process of implementing asset and income control; including organizing random selection of verified people by drawing lots or using computer software. This will be the basis for research and further improvement of legal regulations for this work.

Commenting further on the draft law, Mr. Hoang Van Cuong cited concerns about corrupt criminals dissipating assets to their children and family members. This is an issue that needs to be prevented.

The delegate proposed that the draft supplement the regulation that in cases of criminal prosecution for crimes related to corruption, the prosecution agency can investigate and verify the assets of not only the offender but also those related to them.

Mr. Cuong said that the above regulation will contribute to preventing the act of dissipating assets, both ensuring deterrence and improving the effectiveness of asset recovery.

Concerns about the agency controlling assets and income

In the draft law amendment, the Government proposed to add regulations on the agencies controlling assets and income. Accordingly, the agencies controlling assets and income include: the inspection committee of the Party Committee at the level directly above the grassroots level and above; the Government Inspectorate; the Supreme People's Court, the Supreme People's Procuracy, the State Audit, the Office of the President, the Office of the National Assembly, the National Assembly Delegation Work Committee, the central agencies of socio-political organizations; ministries, ministerial-level agencies, agencies under the Government and provincial-level inspectorates.

The Government believes that the above regulations will unify and synchronize the agencies controlling assets and income, avoiding unclear authority; in accordance with the Party's regulations on controlling assets and income in Decision 56-QD/TW dated February 8, 2022 of the Politburo and Regulation No. 296-QD/TW dated May 30, 2025 of the Central Executive Committee on the Party's inspection, supervision and discipline work.

Participating in the discussion, delegate Hoang Quoc Khanh (Lai Chau delegation) wondered whether including the tasks of Party agencies (currently being implemented according to Party regulations) in the draft law would lead to overlapping functions and tasks between the Party and the State. Not to mention that inspection and examination would also be difficult to carry out.

Mr. Khanh suggested that the drafting committee should study carefully, and if there is any, they should only stipulate the principles, and the concretization should be carried out according to the Party's regulations, in order to avoid overlap and maintain the stability of the law.

Delegate Le Thu Ha (Lao Cai delegation) also found that the draft law specifically states that the Party Committee's inspection committee is the agency that controls the assets and income of Party members. Although it aims to clarify authority, it is not consistent with legislative principles, because the law should only regulate the functions and authority of state agencies without interfering with the Party organization.

Ms. Ha proposed to maintain the principled provisions in Clause 8, Article 30 of the current law, and at the same time amend them to clarify the authority to control assets and income of National Assembly agencies, avoiding duplication and omission of subjects.
