Subjects renting public housing in localities subject to administrative unit arrangement

Deputy Prime Minister Tran Hong Ha signed Decision No. 45/2025/QD-TTg dated December 3, 2025 of the Prime Minister regulating the subjects of renting public housing in localities subject to the arrangement of provincial-level administrative units.

This Decision regulates the subjects of renting public housing and the standards of public housing for cadres, civil servants and public employees in localities subject to the arrangement of provincial-level administrative units.

Subjects renting public housing

According to regulations, the subjects renting public housing include:

- The subjects renting public housing under Point g, Clause 1, Article 45 of the 2023 Housing Law are cadres, civil servants, and public employees who have to move their workplace to a new political -administrative center in localities subject to the arrangement of provincial-level administrative units.

- The subjects specified above must be in the case of not having a house of their own or having a house (including social housing) with the shortest road traffic distance from their house to the workplace (including: main office, branch or representative office of the agency, organization) of 10 km or more in mountainous areas, remote areas with difficult economic conditions, border areas, islands and 30 km or more in the remaining areas.

Interior equipment for official residences up to 120 million VND

Regarding the standards for area and interior equipment of official residences, Decision No. 45/2025/QD-TTg stipulates that Department Heads, Deputy Department Heads of Departments and equivalent, civil servants and public employees in localities subject to the arrangement of provincial-level administrative units are arranged to rent one of two types of official residences, including:

- An apartment with a usable area from 45 m2 to under 60 m2 is designed as a closed living space, with one or more different functional spaces such as: Living room, bedrooms, dining room, kitchen, toilet, balcony or loggia;

- The house has a usable area from 48 m2 to under 60 m2, built in the style of a 1-storey house with many houses close together, each house has a closed auxiliary structure.

The maximum budget for interior equipment for the above-mentioned official residence is 120 million VND.

The Decision clearly states that the Ministry of Construction is responsible for guiding, inspecting and urging localities across the country to implement this Decision.

The People's Committees of provinces and centrally run cities are responsible for allocating capital from local budgets to invest in construction, renovation, repair, and purchase of interior equipment for public housing according to regulations; directing the development, management, and arrangement of public housing for rent, and converting the function of surplus housing funds into public housing in the locality according to the provisions of the law on housing and in accordance with the actual conditions of the locality.

The 2023 Housing Law was passed by the National Assembly and took effect from July 1, 2024, in which Point b, Clause 1, Article 45 stipulates the subjects of renting public housing as follows: “b) Cadres and civil servants of agencies of the Party, State, socio-political organizations... are mobilized, rotated, seconded from central agencies to work in localities or from one locality to another to hold the position of Deputy Director of Department and equivalent or higher;”

However, after the merger of provincial administrative units, many civil servants and public employees with positions equivalent to department-level leaders and equivalent or lower had to move their workplaces from the old locality to the new political-administrative center, making it difficult to stabilize their residences to work with peace of mind, wasting time and incurring many costs./.
