Instructions on conditions for obtaining Vietnamese nationality

According to the provisions of Article 19 of the Law on Vietnamese Nationality, amended and supplemented by Law No. 79/2025/QH15, the conditions for acquiring Vietnamese nationality are as follows:

Firstly , foreign citizens and stateless persons who apply for Vietnamese nationality may be granted Vietnamese nationality if they meet the following conditions: Have full civil act capacity according to the provisions of Vietnamese law , except in the case of minors applying for Vietnamese nationality according to their father or mother, minors whose father or mother is a Vietnamese citizen; Comply with the Constitution and laws of Vietnam; respect the culture and traditions of Vietnam;
traditions, customs and practices of the Vietnamese people; Must know enough Vietnamese to integrate into the Vietnamese community; Currently residing in Vietnam; Permanent residence in Vietnam for 05 years or more up to the time of applying for Vietnamese nationality; Able to ensure a living in Vietnam.

Monday , A person applying for Vietnamese nationality whose spouse or biological child is a Vietnamese citizen can be granted Vietnamese nationality without having to meet the following conditions: Knowing Vietnamese; Permanent residence in Vietnam for 05 years or more and being able to ensure a living in Vietnam.

Third , a person applying for Vietnamese nationality who falls into one of the following cases can be naturalized as Vietnamese without having to meet the conditions of knowing Vietnamese; Currently residing in Vietnam ; Permanent residence in Vietnam for 05 years or more; Able to ensure a living in Vietnam such as: Having a biological father or mother or paternal grandfather and grandmother or maternal grandfather and grandmother who are Vietnamese citizens; Having special meritorious contributions to the cause of building and defending the Vietnamese Fatherland; Beneficial to the Socialist Republic of Vietnam are: “ People with outstanding talents in the fields of science, technology, innovation, digital transformation, economics , law, culture, society, arts, sports, health, education or other fields whose talents have been confirmed by a ministerial-level state management agency or have received international awards, medals, and there is a basis to show that such person will make positive, long-term contributions to the development of the above-mentioned fields in Vietnam; Businessmen and investors are individuals with business and investment activities in Vietnam who have been confirmed by a ministerial-level state management agency that such person will make positive, long-term contributions to the development of Vietnam”; Minors applying for Vietnamese nationality with their father or mother.

Fourth ,a person applying for Vietnamese nationality must have a name in Vietnamese or in another ethnic language of Vietnam. In case a person applying for Vietnamese nationality also applies to retain foreign nationality, he/she can choose a name combining Vietnamese and foreign names. The name is chosen by the person applying for Vietnamese nationality and is clearly stated in the Decision on granting Vietnamese nationality.

Fifth , a person applying for Vietnamese nationality may not acquire Vietnamese nationality if doing so harms the national interests of Vietnam.

Sixth, the person applying for Vietnamese nationality has a wife or husband or biological child or biological father or biological mother or paternal and maternal grandparents who are Vietnamese citizens; Has made special contributions to the cause of building and defending the Vietnamese Fatherland; Is beneficial to the State of the Socialist Republic of Vietnam; Minors applying for Vietnamese nationality with their father or mother may retain their foreign nationality if they meet the following conditions and are permitted by the President :

Retaining foreign nationality in accordance with the laws of that country;

Do not use foreign nationality to harm the legitimate rights and interests of agencies, organizations and individuals, or to infringe upon the security, national interests, social order and safety of the Socialist Republic of Vietnam.

Accordingly, Decree No. 191/2025/ND-CP dated July 1, 2025 stipulates that people
Applying for Vietnamese nationality while also applying to retain foreign nationality must have
The following documents:Documents issued by a competent authority of a foreign country regarding the retention of foreign nationality in accordance with the laws of that country. In case the foreign law does not stipulate the issuance of this type of document, the person must have a written commitment that the competent authority of the foreign country does not stipulate the issuance of this type of document and the application to retain foreign nationality when acquiring Vietnamese nationality.
Nam is in accordance with the laws of that foreign country; Commitment not to use foreign nationality to harm legitimate rights and interests of agencies, organizations and individuals, infringing on security and interests national, order and social security of the Socialist Republic of Vietnam.

Note: In case a person applying for Vietnamese nationality and at the same time applying to retain foreign nationality but does not fully meet the prescribed conditions for obtaining Vietnamese nationality, he/she must renounce his/her foreign nationality./.
