Do I need to reapply for social housing if I get married after my application has been approved?

(Chinhphu.vn) - Ms. Lam Thi Hoa asked: If a single person is eligible to buy social housing, their application has been approved and they have been selected for a unit, but they get married during the installment payment process, will the contract be terminated or will their application be re-approved when the Certificate of Ownership is issued in both their names?

Regarding this matter, the Department of Housing and Real Estate Market Management, Ministry of Construction, provides the following response:

Article 76 of the 2023 Housing Law specifically stipulates the beneficiaries of housing support policies.

Clause 1 of Article 78 of the 2023 Housing Law stipulates that the subjects specified in Clauses 1, 4, 5, 6, 7, 8, 9 and 10 of Article 76, who meet the housing and income conditions specified in this clause, are eligible to purchase or lease-purchase social housing.

Point d, Clause 1, Article 79 of the 2023 Housing Law stipulates the principle for implementing social housing support policies as follows: "Ensuring that the beneficiaries are the correct target group and meet the conditions as prescribed by this Law."

Points d, e, and g of Clause 1, Article 38 of Government Decree No. 100/2024/ND-CP dated July 26, 2024, detailing some provisions of the Law on Housing regarding the development and management of social housing, stipulate:

"d) After gathering all the registration documents from eligible individuals, the investor of the social housing project is responsible for reviewing each registration file, comparing it with the regulations on eligible individuals and conditions as stipulated in Articles 76 and 78 of the Housing Law, and the forms as guided by the Minister of Construction, the Minister of National Defense, and the Minister of Public Security, in order to compile a list of eligible individuals to purchase social housing in the project for which they are the investor..."

d) The investor of a social housing construction project is responsible for submitting a list of prospective social housing buyers, prioritized according to the principles stipulated in Clause 2 of this Article, to the local Department of Construction where the project is located. This list will be used for verification to ensure that eligible buyers are correctly identified and to exclude applicants who have already purchased or leased social housing, or who have received any form of state housing support, in the province or centrally-governed city where the social housing project is located. The competent authority issuing the Certificate of Land Use Rights and Ownership of Assets Attached to Land in the locality where the social housing construction project is located is responsible for coordinating with the local Department of Construction to verify the information within its authority and is accountable for the verification results. At the time of receiving the application and verifying the eligibility, the investor is not required to provide the results of the price appraisal by the competent authority.

g) The investor may only sign a social housing purchase and sale contract with customers when all conditions for sale are met according to the law on housing and the selling price has been appraised and approved by the competent authority as prescribed.

After signing the social housing purchase contract, the project investor is responsible for compiling a complete list of eligible individuals (including all household members) who have purchased social housing and submitting it to the local Department of Construction where the project is located for public announcement within 30 days of receiving this list. The list should also be stored for management and inspection purposes (post-audit). The Department of Construction is responsible for updating the list of eligible individuals on its website as stipulated in Article 44 of this Decree and sending this list (hard copy and electronic file) to the Ministry of Construction for monitoring. Simultaneously, the project investor is responsible for publicly announcing this list at its office and at the real estate exchange or the investor's social housing website (if any).

Thus, housing laws only stipulate the housing conditions and income conditions of those eligible for housing support policies (conditions for applicants) when reviewing applications for social housing.

At the time of application, customers must meet all the eligibility requirements stipulated by housing laws to be eligible to purchase social housing.
