Kinhtedothi- The People's Committee of Nam Dinh province has just issued Decision No. 57/2024/QD-UBND dated November 29, 2024, detailing a number of articles of the Housing Law 2023.
This regulation applies to the province; applies to organizations and individuals participating in investing in the construction of commercial housing and social housing projects in Nam Dinh province (excluding projects using State capital); State management agencies and other relevant organizations and individuals.
Accordingly, the People's Committee of Nam Dinh province details Clause 4, Article 5 (Housing Law 2023) on locations and positions that must develop housing according to the project; Clause 3, Article 83 (Housing Law 2023) on criteria for commercial housing construction investment projects in which the project investor must reserve a part of the residential land area in the project that has invested in building a technical infrastructure system to build social housing or arrange the social housing land fund that has invested in building a technical infrastructure system in a location other than the scope of the commercial housing construction investment project in that urban area or pay money equivalent to the value of the land fund that has invested in building a technical infrastructure system to build social housing.
The regulations issued with Decision No. 57 of the Nam Dinh Provincial People's Committee clearly state that housing development is mainly carried out according to projects, with housing types and areas suitable to market needs at locations and positions adjacent to National Highways 10 and 21 (including service roads), in areas planned to be established as urban areas according to the approved Nam Dinh Provincial Planning.
Criteria for commercial housing construction investment projects in which the investor of the commercial housing construction investment project must reserve a portion of the residential land area in the project that has invested in building a technical infrastructure system to build social housing, or arrange the social housing land fund that has invested in building a technical infrastructure system in a location other than the scope of the commercial housing construction investment project in that urban area, or pay money equivalent to the value of the land fund that has invested in building a technical infrastructure system to build social housing.
In the case of reserving a portion of the residential land area that has invested in building technical infrastructure systems in a commercial housing construction investment project to build social housing in a type IV urban area, a commercial housing construction investment project with an area of 20 hectares or more or a population of 4,000 people or more, the investor of that project shall reserve at least 20% of the total residential land area (excluding existing residential land and resettlement land) within the scope of the project, which has invested in building technical infrastructure systems to build social housing.

In case of arranging social housing land fund that has invested in building technical infrastructure system in a location other than the scope of commercial housing construction investment project, the Provincial People's Committee shall decide on the arrangement of social housing land fund that has invested in building technical infrastructure system in a location other than the scope of commercial housing construction investment project when approving the investment policy...
In case of payment of money equivalent to the value of land fund invested in building technical infrastructure system to build social housing: in urban areas of type IV, the Provincial People's Committee, when approving the investment policy of a commercial housing construction investment project, approves the investor to implement the commercial housing construction investment project under its authority, considers and decides not to reserve the residential land fund invested in building technical infrastructure system in the project and approves the investor of that project to pay money equivalent to the value of the residential land fund invested in building technical infrastructure system to be reserved for building social housing.
The amount that the investor must pay in accordance with the provisions of the law on land use fees and land rent, calculated at the time of investment in construction of the technical infrastructure system, must be paid into the local budget and managed and used in accordance with the provisions of the law on the State budget.
Decision No. 57/2024/QD-UBND of Nam Dinh Provincial People's Committee takes effect from December 10, 2024.
