Speaking at the group, Delegate Hoang Van Cuong, National Assembly Delegation of Hanoi City expressed his joy as an educator when Resolution 71 was issued. According to the Delegate, Resolution 71 highly appreciated and placed the right position of the education sector in the future of the country. Therefore, the National Assembly Resolution institutionalizing the policies of Resolution 71 must achieve a level not lower than the orientations set out in Resolution 71.
Regarding special policies and superior treatment, including allowances for teachers, Delegate Hoang Van Cuong said that the policies stipulated in Resolution 71 of the Politburo meet the requirements of the Law on Teachers, which is to have higher treatment for teachers.
"The policy assigns the Education sector to organize the recruitment and management of teachers in provincial units. This means that the Department of Education and Training is responsible for recruiting and arranging suitable arrangements within the sector. This avoids the situation where there are places with excess or shortage of teachers and where they cannot be mobilized. When the Department of Education and Training takes responsibility for the recruitment level, the quality of recruitment will be evaluated equally. This brings benefits to teacher candidates and the Education sector. I highly appreciate the breakthrough in this mechanism," Delegate Hoang Van Cuong shared.
Delegate Hoang Van Cuong highly appreciated the content: Giving vocational training institutions and universities the right to arrange and determine job positions for foreign experts. Previously, 3 universities were given this mechanism: University of Economics, Ho Chi Minh City National University, National Economics University, Hanoi University of Science and Technology when the Prime Minister issued a special Resolution on signing contracts with foreign scientists. In fact, foreign scientists will not apply for a license, but if it is assigned to the proposed unit, it will be much better. Citing the National Economics University, Delegate Hoang Van Cuong said that when applying the special mechanism, 5 universities invited 60 Nobel Prize-winning scientists...
However, Delegate Nguyen Tuan Thinh, Hanoi National Assembly Delegation, suggested that the Department of Education and Training should do the recruitment, while the reception, mobilization, transfer, arrangement, and secondment of teachers should be carried out according to the authority as per the current law, that is, the Department should carry out the work for educational institutions that the Department is assigned to manage (level 3 and above); the commune level should carry out the work for the institutions that the commune level manages (level 1, level 2 and preschool). The work assignment and arrangement should be handed over to the educational institutions.
Delegate Le Thu Ha, National Assembly Delegation of Lao Cai province, agreed with the examining agency on the political and legal basis and objectives of the draft, which is to remove long-standing institutional bottlenecks (teacher policy, resource allocation, land, digital transformation, etc.). However, the current draft "has both breakthrough content and many technical supplementary contents" for laws that are being or will be amended (such as the Law on Teachers, the Law on Higher Education). If we do not "separate the bad from the good", it is easy to lead to a situation where an issue will be regulated in many documents with different effects and deadlines, causing difficulties in organizing implementation.
Delegate Le Thu Ha emphasized that it is reasonable to assign centralized authority to the Director of the Department of Education and Training to handle the situation of local surpluses and shortages among localities in the same province, avoiding fragmentation of authority. However, it is necessary to clearly adjust the scope of mobilization related to two or more commune-level administrative units in the same province, avoiding misunderstandings of expansion to other provinces. At the same time, it is necessary to supplement the monitoring and transparency mechanism, including the requirement to build a database of human resources in the provincial education sector, publicize quotas, lists of successful candidates, mobilization criteria, etc.
Regarding the source of financial payment, delegate Le Thu Ha said that it is necessary to clearly affirm that the signing of contracts with foreign experts and scientists only uses legal sources of income outside the state budget, avoiding creating pressure on regular budget expenditures. Extending the period of confirmation of work permit exemption to 3 years (while the current Decree allows a maximum of 2 years)... Therefore, it is necessary to have a detailed explanation of risk assessment, criteria and extension mechanism.
