Ms. Khuyen has been participating in social insurance since March 2015. She heard that according to the amended Social Insurance Law, those who participate in social insurance from July 1, 2025, after stopping participation for one year and not continuing to participate, will not be able to withdraw their social insurance in a lump sum, so she is worried.
"If I participate in social insurance until 2030 and then quit my job, will I be able to withdraw my social insurance contributions in a lump sum for the entire period from March 2015 to 2030, or only for the period from March 2015 to July 1, 2025?", Ms. Khuyen asked.
Workers who participated in social insurance before July 1, 2025, are entitled to withdraw their social insurance contributions in a lump sum according to the provisions of the 2014 Social Insurance Law (Illustrative image: Son Nguyen).
The Vietnam Social Security (BHXH Vietnam) stated: "On June 29, 2024, at the 7th session of the 15th National Assembly , the amended Law on Social Insurance was passed, effective from July 1, 2025, with many important amendments, including regulations on receiving a lump-sum social insurance payment."
Specifically, for workers who contributed to social insurance before the effective date of the amended Social Insurance Law, after 12 months they are not subject to mandatory social insurance contributions, do not participate in voluntary social insurance, and have contributed to social insurance for less than 20 years, and have the need, they are entitled to receive a lump-sum social insurance payment.
Therefore, in Ms. Khuyen's case, having participated in social insurance from March 2015 to 2030 (less than 20 years) and after 12 months not being subject to mandatory social insurance contributions, and not participating in voluntary social insurance, if she wishes to receive a lump-sum social insurance payment, she will be granted a lump-sum payment for the total period of social insurance contributions mentioned above.
Ms. Huong, a worker in Dong Nai, also intends to withdraw her social insurance contributions in a lump sum. She has contributed to social insurance for 19 years and 3 months and is not yet old enough to retire.
Ms. Huong asked: "According to the new regulations, am I eligible to withdraw my social insurance contributions in a lump sum? I haven't quit my job yet. If I want to withdraw my social insurance contributions in a lump sum, do I have to quit my job before July 1, 2024, to meet the condition of not participating in social insurance for 12 months before July 1, 2025?"
According to Vietnam Social Security, in Ms. Huong's case, after ceasing mandatory social insurance contributions, and after 12 months not being subject to mandatory social insurance, not participating in voluntary social insurance, and not having accumulated 20 years of social insurance contributions, if she wishes to receive a lump-sum social insurance payment, she is not bound by the July 1, 2025 deadline as she feared.
However, Vietnam Social Security recommends: "You have contributed to social insurance for 19 years and 3 months. To ensure your long-term social security benefits, you should consider continuing to participate in social insurance instead of receiving a lump-sum payment to qualify for a pension. In that case, in addition to receiving a pension, you will also enjoy many better benefits after retirement, including health insurance."
