On the afternoon of June 17th, Dr. Nguyen Trong Khoa, Deputy Director of the Department of Medical Examination and Treatment Management, Ministry of Health, stated that the Ministry had received an urgent report from the Central Institute of Forensic Psychiatry in Bien Hoa, Dong Nai, regarding a plan to stabilize the workforce at the unit after several officials were arrested and summoned.
The Central Institute of Forensic Psychiatry in Bien Hoa has sent a letter to the Ministry of Health appealing for help after 13 of its officials were arrested and summoned for questioning (Illustrative image).
This morning, Deputy Minister of Health Do Xuan Tuyen sent a document to Central Psychiatric Hospital 1, Central Psychiatric Hospital 2, Central Institute of Forensic Psychiatry; Bien Hoa Central Institute of Forensic Psychiatry; regional Forensic Psychiatry Centers; Da Nang Department of Health and the Inspectorate of the Ministry of Health regarding strengthening management and direction in the field of forensic psychiatric assessment and compulsory treatment.
To ensure that forensic psychiatric examinations and mandatory treatment are implemented strictly and in accordance with regulations, meeting the requirements of the prosecuting authorities; to accurately assess the mental state of the subjects being examined, and to prevent negative practices; the Ministry of Health has issued a series of urgent requirements for relevant units to implement.
Accordingly, units conducting forensic psychiatric examinations and compulsory treatment receive requests from prosecuting authorities, organizations, and individuals, and must ensure that the examinations are objective, truthful, accurate, and conducted according to the procedures and regulations of the Law on Judicial Expertise and Circular No. 23/2019 of the Ministry of Health "Issuing the Procedure for Forensic Psychiatric Examination and Forms Used in Forensic Psychiatric Examination".
Forensic examiners must meet the standards stipulated in Circular No. 11/2022 of the Ministry of Health "Regulations on standards, dossiers, procedures for appointment, issuance, dismissal, and revocation of forensic examiner and forensic psychiatric examiner cards"; in addition, they must seriously conduct self-assessment of the unit's activities according to the prescribed criteria and scoring system.
At the same time, closely coordinate with local Party committees, authorities, and specialized agencies in the area, proactively implement contract signing, and closely cooperate with medical units to conduct specialized examinations and paraclinical examinations for the target groups on the basis of efficiency, economy, avoiding waste, and strictly managing the target groups.
Strengthen information exchange with investigative agencies and the procuracy regarding the situation and results of expert examinations as requested; Only accept expert examinations when all required documents are available; Only hand over expert examination conclusions and the examined subjects to individuals and organizations in accordance with the law.
In particular, the Ministry of Health requested that units review, compile, and propose specific content for amending regulations that are no longer appropriate.
The Ministry's Inspectorate is tasked with leading and coordinating with the Department of Medical Examination and Treatment Management to review units before June 30th. Based on the review results, immediate surprise inspections will be conducted on units showing signs of violations in forensic psychiatric assessment and compulsory treatment; at the same time, this content will be included in the annual inspection plan submitted to the Ministry of Health for consideration and decision.
On the afternoon of June 17th, the Ministry also held in-person and online meetings with hospitals and institutes within the forensic psychiatric assessment system across the entire system, as well as specialized departments/bureaus, to provide guidance on reviewing, resolving difficulties, and supporting the Central Forensic Psychiatric Institute in Bien Hoa.
On June 16th, the Central Institute of Forensic Psychiatry in Bien Hoa sent a letter to the Ministry of Health appealing for help after 13 of its officials (including 2 retirees) were arrested and summoned by the C02 unit of the Ministry of Public Security for investigation into the creation of records related to the results of patient assessments and treatment at the institute.
