The Politburo 's regulations on controlling power and preventing corruption and negative practices in personnel work clearly state acts of exploiting and abusing positions and authority in personnel work; and acts of seeking positions and power through illicit means.
Combating corruption in personnel management.
On behalf of the Politburo, Politburo member and Standing Committee Secretary Truong Thi Mai signed Regulation 114 on controlling power and preventing and combating corruption and negative practices in personnel work.
With 15 articles, Regulation 114 stipulates acts of corruption and misconduct in personnel work; responsibilities for controlling power and preventing and combating corruption and misconduct in personnel work; and handling violations.
This regulation clearly defines acts of exploiting and abusing positions and authority in personnel management, including:
Using one's own prestige and influence, as well as that of family members, to suggest, influence, or pressure others into making decisions, giving directions, providing advice, making proposals, commenting, evaluating, voting, conducting confidence votes, nominating personnel, or casting votes according to one's own wishes.
To allow family members or close acquaintances to exploit their positions, authority, and prestige to influence, manipulate, and interfere in various stages of personnel management.
Personal agendas are being incorporated into various stages of personnel management, driven by motives of self-interest or benefiting the personnel involved.
Directing and advising on personnel matters related to staff who do not meet the required qualifications and standards; or who are not in accordance with principles, regulations, procedures, rules, and decisions.
Delaying or failing to implement personnel procedures when perceived as disadvantageous, or choosing a time that is advantageous to the personnel according to one's own preferences.
Upon receiving complaints, denunciations, or knowing that personnel have engaged in corrupt or negative behavior in personnel management, but compromising, condoning, or covering up wrongdoing by failing to handle it within their authority, handling it improperly, or failing to report it to the competent authority for handling...
Confirmation, authentication, comments, or evaluations that are coercive, inaccurate, untrue, or that falsify or distort the content of personnel records, election results, nomination votes, confidence votes, selection processes, or examinations for the benefit of personnel or to achieve personal goals.
Providing or disclosing information, documents, or personnel records of officials and Party members to organizations and individuals without authority or responsibility, especially information, documents, or personnel records that are currently undergoing personnel management procedures.
Clearly identify acts of bribery and corruption in securing positions and power.
Regulation 114 also clearly defines acts of seeking positions and power through illicit means, specifically including:
Directly or indirectly brokering, giving, and receiving bribes to help others obtain positions, offices, or benefits.
Giving gifts, money, real estate, or other material or non-material benefits, arranging recreational activities for people in positions of authority or responsibility with the aim of gaining support, trust, position, office, or privileges.
Manipulating age, years of service, honorary titles, awards, qualifications, assignments, appointments, nominations, candidacies, designations, transfers, rotations, secondments, promotions, and military ranks... all with the aim of meeting the standards and conditions to obtain positions and benefits.
Exploiting personal relationships or using the advantages, position, or reputation of others to influence, manipulate, or pressure those in positions of authority or responsibility in order to obtain positions, titles, or benefits...
Other negative behaviors include meeting, contacting, or communicating with personnel in violation of regulations during the personnel selection process; harassment, causing difficulties, inconvenience, delays, and imposing conditions on personnel and the agencies that nominated them...
Regulation 114 also emphasizes the prohibition of appointing individuals with family ties to simultaneously hold related positions such as members of the same Party Standing Committee, Party Committee, Party Group, or leadership team of an agency or unit.
The head and deputy head within the same locality, agency, or unit. The head of the Party committee or administrative agency and the heads of agencies such as the Ministry of Interior, Inspectorate, Finance, Banking, Tax, Customs, Industry and Trade, Planning and Investment, Natural Resources and Environment, Military, Public Security, Courts, and Procuratorates at the central level or at the local level.
In cases where no suitable personnel option is available, and the candidate is a highly trusted family member, a report must be submitted to and approval obtained from the immediate superior Party committee before any appointment can be made.
For positions under the management of Party committees and Party organizations directly under the Central Committee, reports must be submitted to the Central Organization Department; for positions under the management of the Central Committee, reports must be submitted to the Central Organization Department for onward reporting to the competent authority.
The regulations clearly state that if officials, Party members, civil servants, or public employees violate the rules, the competent authority will consider and handle the matter according to regulations. The competent authority will also consider and apply disciplinary measures as prescribed.
This regulation replaces Regulation 205/2019 of the Politburo on controlling power in personnel work and combating bribery for positions and power.
