
The Government has just issued a Resolution on the specialized meeting on law-making in January 2025.
One of the notable contents is the draft Resolution of the National Assembly on the establishment of a number of ministries on the basis of reorganizing a number of ministries of the Government of the 15th National Assembly term and the draft Resolution of the National Assembly on the structure of Government members of the 15th National Assembly term.
Create a "transparent" mechanism.
Accordingly, the Government agrees on the necessity of developing and promulgating these resolutions. The Government assigns the Ministry of Home Affairs to continue to complete the draft resolution in the direction of defining the names of ministries and agencies in accordance with the decision of competent authorities.
Regarding the structure of Government members, the Government noted that it only stipulates in principle about Deputy Prime Ministers; the specific number of Deputy Prime Ministers is determined based on the practical situation of each period.
Regarding the draft Resolution of the National Assembly on handling certain issues related to organizational restructuring, the Government basically agrees with the Ministry of Justice's proposals on the policies submitted by the Ministry of Justice.
The government has instructed the Ministry of Justice to continue researching and reviewing the solutions for each policy, incorporating feedback from government members to finalize them.
Specifically, Policy 1: Issuing specific regulations to address certain related issues to ensure the continuous, smooth, and convenient operation of agencies, society, citizens, and businesses during the reorganization of the administrative apparatus.
Policy 2: Promulgate regulations on the responsibilities and deadlines for reviewing and amending legal documents by relevant agencies to address issues within their jurisdiction, beyond those that can be addressed according to the provisions of the Resolution.
At the same time, it stipulates the authority and responsibility for handling other issues arising after the reorganization of the organizational structure that are not regulated in the Resolution, as well as some transitional issues.
In particular, the Government noted creating an "open" mechanism for competent agencies and organizations to issue temporary guidance documents to promptly handle arising issues not foreseen in the resolution.
This also allows the Government to issue regulations specifying the functions, tasks, powers, and organizational structure of agencies under its authority that differ from the provisions of current laws and ordinances in the period following the reorganization of the administrative apparatus, but before the regulations have been promptly amended or supplemented...
The Government has assigned the Ministry of Justice to take the lead, in coordination with the Government Office and relevant agencies, in urgently completing the draft resolution dossier and submitting it to the competent authority for approval of the simplified procedures, ensuring quality and timeliness, and promptly presenting it to the National Assembly at the 9th extraordinary session in February 2025.
Creating a legal framework for the improvement of the organizational apparatus
Regarding the draft Law on Government Organization (amended) and the draft Law on Local Government Organization (amended), the Government highly appreciated the Ministry of Home Affairs for proactively presiding over and coordinating with relevant ministries and agencies to complete the two draft laws in a short time.
Specifically, the draft Law on Government Organization (amended) aims to create a legal framework for improving the organizational structure of the Government, reforming and reorganizing the state administrative apparatus to be "lean, strong, efficient, effective, and effective," meeting the requirements of building and perfecting the socialist rule of law state of Vietnam in the new situation.
The draft law needs to focus on harmoniously, reasonably, effectively, clearly and specifically resolving the relationship between Government agencies; between Government agencies and central agencies such as the National Assembly, the Central Committee of the Vietnam Fatherland Front, the Supreme People's Court, the Supreme People's Procuracy... and between Government agencies and local authorities.
The Government noted that decentralization and delegation of power must be associated with ensuring resources, promoting the responsibility of leaders, and strengthening inspection and supervision of implementation.
In addition, the Government also requested the Ministry of Interior to urgently finalize the draft Law on Organization of Local Government (amended) in the direction of clearly defining the model of local government organization suitable to the characteristics of rural areas, urban areas, islands, etc.
This bill is expected to be submitted to the National Assembly at the 9th Extraordinary Session this February.
