At the 52nd session held on the afternoon of December 4, the National Assembly Standing Committee gave opinions on the draft Resolution of the National Assembly on specific mechanisms and policies to implement major projects in the capital Hanoi .
Clearing legal bottlenecks, attracting investment, creating breakthroughs
Presenting the Draft Resolution of the National Assembly on piloting a number of specific mechanisms and policies to implement large and important projects in the capital, Minister of Finance Nguyen Van Thang said that Hanoi is the capital, the political -economic-cultural center, and at the same time a special-class urban area with the role of one of the two economic locomotives of the country. The city is implementing a large number of key projects, including public investment projects, investment projects under the public-private partnership (PPP) method, projects to attract strategic investors, and projects to renovate and beautify urban areas and rebuild old apartment buildings.
The implementation of the above-mentioned large-scale, key projects, especially the extremely large-scale projects to be implemented in the coming time, will encounter many difficulties and obstacles, hindering the maximization of the role and position of the Capital, especially in the context of double-digit growth in the period 2026-2030.
On June 28, 2024, the National Assembly issued the amended Law on the Capital, which is the legal basis and an important tool for Hanoi to continue to affirm its central position. However, in reality, the Law on the Capital has not completely resolved the overlap and lack of decentralization in investment management.
Given the above situation, the issuance of the National Assembly Resolution allowing Hanoi to pilot a number of specific mechanisms and policies to implement large and important projects in the capital is necessary and urgent, in order to clear legal "bottlenecks", attract investment, create breakthroughs, develop faster, more sustainably, and have greater spillover effects in the economic development of the Red River Delta and the whole country.
The Resolution will create a solid foundation to achieve an average economic growth rate of 11% per year or more, while also being consistent with the requirements of innovation in management thinking, strengthening decentralization and delegation of power to the Capital in the spirit of Resolution No. 66-NQ/TW dated April 30, 2025 of the Politburo. Based on the results of the pilot implementation in Hanoi, it will be summarized and summarized to allow uniform application nationwide when it is effective in practice.
According to the draft Resolution of the National Assembly on specific mechanisms and policies to implement major projects in the capital, major and important projects in the capital include public investment projects, PPP projects, and projects that need to be implemented immediately under the direction of the Politburo, the Secretariat, the Government Party Committee, and the Hanoi Party Committee.
In addition, this group also includes projects that meet important national criteria; projects using local budgets or in the list of attracting strategic investors with a total investment of VND30,000 billion or more; projects to renovate old apartment buildings; and to handle bottlenecks such as traffic jams, flooding, and environmental pollution.
According to the Draft Resolution, the first highlight is the proposal to expand the authority to decide and approve investment policies for the Capital. Accordingly, the People's Council and the Chairman of the City People's Committee will be able to decide on investment policies and approve investment policies for public, PPP, and private investment projects without being limited in terms of capital scale, land use, or resettlement requirements. These projects may fall under the current authority of the National Assembly, the Government, and the Prime Minister.
For projects requiring special mechanisms different from the provisions of the Law, Resolution of the National Assembly, Ordinance, Resolution of the National Assembly Standing Committee, the Minister said, the City People's Committee will report to the Government to submit to the National Assembly Standing Committee for permission to implement, then report to the National Assembly at the nearest session.
Regarding the selection of investors and contractors, the draft Resolution allows the application of the form of selecting investors and contractors in special cases for projects that need to be implemented immediately under the direction of competent authorities, important national projects, and projects attracting strategic investors. In particular, for projects that need to be implemented immediately, the city is allowed to select investors before competent authorities decide or approve the investment policy, and at the same time, carry out planning procedures and start construction at the same time as the procedures for approving/deciding on the investment policy.
In the field of planning, the Government proposes to establish only one Master Plan for the Capital to specify the national and regional planning, while integrating the contents of the capital planning and adjusting the current master plan for the Capital.
The report also proposed breakthrough mechanisms for land acquisition, land allocation, land lease and capital mobilization. The City People's Committee is allowed to use the city budget to implement independent compensation, support and resettlement projects before approving the investment policy. Accordingly, for projects that need to be implemented immediately, the City People's Council is entitled to decide on compensation, support and resettlement levels twice the prescribed level. In other cases, the compensation level is allowed to be higher than the prescribed level but not more than twice. Notably, in the capital mobilization mechanism, the City People's Council is allowed to use the surplus of the city budget to allocate capital for the project...
In addition, to handle urgent traffic bottlenecks, flooding, and environmental pollution, the Proposal proposes applying an emergency public investment mechanism and an emergency construction order...
It is necessary to develop and promulgate a Resolution.
Examining the above content, Chairman of the Economic and Financial Committee Phan Van Mai affirmed his agreement with the necessity and practical basis of building a Resolution according to shortened procedures.
However, the Standing Committee of the Economic and Financial Committee proposed to review and revise so as not to stipulate in the contents already in the current laws and resolutions, in order to ensure consistency and only keep the truly specific and necessary policy mechanisms. At the same time, it proposed to continue reviewing and ensuring that only the draft Resolution stipulates specific contents under the authority of the National Assembly...

In addition, the Standing Committee of the Economic and Financial Committee agreed on the policy of integrating the Capital Planning and the Capital Master Plan into a unified plan, but suggested reviewing the Law on Planning and the Law on Urban and Rural Planning to determine the location, hierarchy and relationship of the Capital Master Plan, avoiding overlaps and legal gaps. Speaking at the meeting, National Assembly Chairman Tran Thanh Man expressed his agreement on the issuance of the Resolution. This is an immediate Resolution, in the coming time, the Law on the Capital City, especially Articles 4 and 37, will have to be amended to resolve the bottlenecks. This Resolution was developed and issued with the aim of removing obstacles, mobilizing and effectively using resources to promote the rapid, sustainable, modern development of the Capital City, with the power to spread and lead the region and the whole country, promoting double-digit economic growth in the 2026-2030 period, realizing the vision of developing the Capital City by 2045.
Noting some contents, the National Assembly Chairman suggested that the drafting of the resolution should closely follow Resolution 66 of the Politburo and Document 19076 of the Party Central Office dated November 21, 2025. Review the draft Resolution with existing policy mechanisms in the Law on the Capital, the Law on Bidding, the Law on State Budget and the mechanisms and policies considered at this tenth session to remove obstacles and difficulties in land, planning and investment. Any content that is already in current laws or has been decided at the session should be eliminated; only include truly outstanding mechanisms that are effective in removing bottlenecks, avoiding arbitrary expansion and scattered and formal regulations.
Regarding the scope of the Resolution, it is necessary to clearly define the focus and key points, avoiding overlap between project groups. Regarding the authority to decide on investment policy approval, it is necessary to note: For important national projects that have far-reaching impacts not only on the Capital but also on the whole region; it is necessary to cut down and simplify administrative procedures to ensure flexibility and timeliness, so that the city can speed up the progress of urgent and key projects.
The selection of investors and contractors must ensure fairness and transparency. Note the post-audit mechanism, allowing simultaneous implementation of procedures, limiting the risk of breaking the general planning, not ensuring technical design requirements.
Speaking at the meeting, Chairman of the Hanoi People's Committee Vu Dai Thang said that the ministries and branches together with Hanoi have thoroughly reviewed the projects and works that are stuck on the practical basis. The policies proposed by Hanoi have also been assessed by the ministries and branches and submitted by the Government to the National Assembly Standing Committee. Hanoi has reviewed and compared them with current documents and this is the wish of the Capital as well as the ministries and branches to resolve the problems, especially for key projects, large and important projects of the Capital in the coming time.
Along with this, the Capital is also preparing a proposal to the Politburo and the Central Committee to amend Resolution No. 15-NQ/TW of the Politburo as a political basis for amending the Law on the Capital and is expected to be submitted in the near future. Due to the urgent nature, Hanoi hopes that this Resolution will be passed in order to promptly implement a number of works and projects, meeting the development requirements of the Capital over a long period of time, which the city has now determined to plan with a 100-year vision.
Concluding the session, Vice Chairman of the National Assembly Vu Hong Thanh stated that the National Assembly Standing Committee highly appreciated the relevant agencies for proactively, actively and promptly organizing the review of the draft Resolution. The review report was also carefully prepared with many very valid opinions.
The Vice Chairman of the National Assembly emphasized that the National Assembly Standing Committee basically approved the contents of the draft Resolution dossier, the draft is eligible to be added to the 2025 Law and Ordinance Building Program, and submitted to the National Assembly for consideration and approval according to the shortened procedures at the ongoing 10th Session.
