Focus on regulating truly superior mechanisms, avoiding arbitrary expansion

Commenting on the draft Resolution of the National Assembly to pilot a number of specific mechanisms and policies to implement large and important projects in the capital, the National Assembly Standing Committee proposed that it is necessary to ensure focus on regulating truly outstanding mechanisms, removing bottlenecks, and avoiding arbitrary expansion.

On the afternoon of December 4, continuing the 52nd Session, under the direction of Vice Chairman of the National Assembly Vu Hong Thanh, the National Assembly Standing Committee gave opinions on the draft Resolution of the National Assembly on special mechanisms and policies to implement large and important projects in the capital.

Projects to solve traffic congestion, flooding, and environmental pollution are subject to emergency mechanisms.

Presenting the Government's Report on the National Assembly's draft Resolution on piloting a number of specific mechanisms and policies to implement large and important projects in the capital, Minister of Finance Nguyen Van Thang said that the draft Resolution stipulates many policies to simplify administrative procedures through decentralization of authority and integration of many parallel implementation steps.

Regarding the decentralization of authority to decide and approve investment policies, the draft Resolution stipulates that projects under the authority of the National Assembly, the Government, and the Prime Minister according to current regulations are assigned to the City People's Council or the Chairman of the City People's Committee to decide/approve investment policies; the City People's Council shall issue separate, simplified, and flexible processes and procedures.

Minister of Finance Nguyen Van Thang presented the Government's Report on the draft Resolution of the National Assembly on piloting a number of specific mechanisms and policies to implement large and important projects in the capital.

To shorten the planning process and adjustment: Only establish one Master Plan of the Capital integrating all current plans; adjust all types of planning of the Capital in a shortened order and carry out simultaneously with the investment policy and project approval procedures; allow approval of detailed plans different from zoning plans, and update when adjusting zoning plans.

In particular, to solve problems of traffic congestion, flooding, environmental pollution, and urban order, the draft Resolution stipulates that new investment projects and construction renovations to handle bottlenecks and urgent issues should apply the emergency public investment mechanism and emergency construction orders according to the law on public investment and construction.

The Draft Resolution also eliminates some procedures; simplifies procedures in land acquisition, land allocation, and land leasing; for urban renovation, beautification, and reconstruction projects, decisions on demolition and renovation are allowed based on representative inspection, without the need for full inspection.

In the preliminary review report of the Resolution project, Chairman of the Economic and Financial Committee Phan Van Mai said that the Standing Committee of the Committee agreed with the necessity, political basis and practical basis of building and promulgating the Resolution according to the shortened procedures, aiming to institutionalize the policy of the Politburo in Official Dispatch No. 19076-CV/VPTW, contributing to removing institutional bottlenecks, mobilizing resources, promoting the rapid, sustainable, modern development of the Capital, with regional and national radiative effects.

For special, important, complex mechanisms and policies with a large scope of impact, such as expanding the case of land recovery compared to Article 79 of the Land Law (Clause 2, Article 7), the Governor of the State Bank decides on the total outstanding credit balance exceeding the rate prescribed by the law on credit (Clause 2, Article 8) and enforces when reaching 75% consensus (Clause 4, Article 10), etc. The Standing Committee of the Committee believes that these are contents that directly affect the rights and legitimate interests of the people, financial security, national currency and macroeconomic stability.

Therefore, the Standing Committee of the Economic and Financial Committee recommends reporting to competent authorities, and carefully assessing the legal, economic, social impacts and implementation risks, ensuring that no complicated complaints or lawsuits arise, affecting social stability, security and order, and people's trust, in accordance with the Constitution and the Politburo's policies.

In the long term, the Capital Law must be amended.

Speaking at the meeting, National Assembly Chairman Tran Thanh Man agreed with the need to issue a National Assembly Resolution piloting a number of specific mechanisms and policies to implement large and important projects in the capital. At the same time, he noted that issuing this Resolution is a short-term solution, in the long term, it will be necessary to amend the Law on the Capital, especially amending Articles 4 and 37 to resolve the bottlenecks.

The National Assembly Chairman stated that this Resolution was developed and issued with the aim of removing obstacles, mobilizing and effectively using resources to promote the Capital's rapid, sustainable, modern development, with the power to spread and lead the region and the whole country, promoting double-digit economic growth in the 2026-2030 period, realizing the vision of developing the Capital by 2045", the National Assembly Chairman emphasized.

Therefore, to complete the draft Resolution, the National Assembly Chairman proposed to closely follow Resolution 66 of the Politburo and Document 19076 of the Central Office dated November 21, 2025.

At the same time, review the draft Resolution with existing policy mechanisms in the Law on the Capital, the Law on Bidding, the Law on Investment under the public-private partnership model, the Law on State Budget and the mechanisms and policies considered at this 10th Session to remove obstacles and difficulties in land, planning and investment.

“Any content that is already in current laws or has been decided at the Session should be eliminated. Ensure that the Resolution focuses on regulations on truly outstanding mechanisms that are effective in removing bottlenecks, avoiding arbitrary expansion and scattered, formal regulations,” the National Assembly Chairman emphasized.

The National Assembly Chairman also stated that the scope of the Resolution needs to clearly define the focus and key points, avoiding overlap between project groups.

Regarding the authority to decide on investment policy approval, the National Assembly Chairman noted that for important national projects that have far-reaching impacts not only on the capital but also on the whole region, administrative procedures must be cut and simplified to ensure flexibility and timeliness, helping the City to speed up the progress of urgent and key projects.

The selection of investors and contractors must ensure fairness and transparency. Pay attention to the implementation method, post-audit mechanism, allowing simultaneous implementation of procedures, limiting the risk of breaking the general planning, not ensuring design requirements, necessary conditions, affecting the progress and quality of the project.

Regarding architectural planning, the National Assembly Chairman agreed to review the draft Law on Planning (amended) and the Law on Urban and Rural Planning submitted to the National Assembly at this Session. The issue of integrated planning should be resolved for all four major cities in the general law, not just Hanoi in this Resolution.

National Assembly Chairman Tran Thanh Man also emphasized that the National Assembly issues a Resolution with general regulations, and the Government will provide specific instructions for Hanoi to proactively implement specific issues in direction and administration.

In his concluding remarks, Vice Chairman of the National Assembly Vu Hong Thanh requested that the drafting agency review and supplement the dossier and complete the legal, political and practical basis of the specific mechanisms and policies. Report clearly the relationship, differences and ensure consistency, avoiding overlaps and duplications between the draft Resolution and the mechanisms and policies in the Capital Law, related Law projects and Resolutions submitted to the National Assembly for consideration at the 10th Session.
