Handling difficulties in building a national database on administrative violations handling

The Government has just issued Resolution No. 66.9/2025/NQ-CP (dated December 8, 2025) on addressing difficulties and obstacles in regulations on the responsibility for building and managing the National Database on Handling Administrative Violations.

This resolution stipulates the responsibilities of ministries, sectors, and localities in building and managing the national database on administrative violations during the period before the promulgation of the amended Law on Handling Administrative Violations. Specifically: The Ministry of Public Security is responsible for building and managing the national database on administrative violations in a centralized, unified, and shared manner nationwide; and fulfilling the responsibilities of the managing agency of the national database on administrative violations in accordance with the law on electronic transactions. The Ministry of Justice shall exploit and use the national database on administrative violations to manage the enforcement of laws on handling administrative violations in accordance with the law.

Within their respective duties and powers, ministries, ministerial-level agencies, and People's Committees at all levels shall promptly provide information on the handling of administrative violations to the Ministry of Public Security for the purpose of building and updating the National Database on the Handling of Administrative Violations.

The Supreme People's Court, the Supreme People's Procuracy , and the State Audit Office shall coordinate with the Ministry of Public Security to build and manage the national database on handling administrative violations; and direct People's Courts at all levels, People's Procuracies at all levels, and agencies under the State Audit Office to promptly provide information on handling administrative violations to the Ministry of Public Security for the purpose of building and updating the national database on handling administrative violations. Ministers, heads of ministerial-level agencies, the Chief Justice of the Supreme People's Court, the Prosecutor General of the Supreme People's Procuracy, the Auditor General, and the chairmen of People's Committees of provinces and cities are responsible for implementing this Resolution, ensuring transparency, effectiveness, and feasibility; and preventing loopholes, corruption, negative practices, losses, and waste.

To ensure consistency and uniformity, the Resolution also promulgates a list of 6 legal documents that need to be amended and supplemented, including: Law on Handling Administrative Violations No. 15/2012/QH13, amended and supplemented by Law No. 67/2020/QH14 and Law No. 88/2025/QH15; Decree No. 20/2016/ND-CP stipulating the National Database on Handling Administrative Violations; Decree No. 11/2020/ND-CP stipulating administrative procedures in the field of State Treasury; Decree No. 118/2021/ND-CP detailing some articles and measures for implementing the Law on Handling Administrative Violations, amended and supplemented by Decree No. 68/2025/ND-CP and Decree No. 190/2025/ND-CP; Decree No. 278/2025/ND-CP stipulates mandatory data connection and sharing between agencies within the political system; Circular No. 09/2025/TT-BTP guides the functions, tasks, and powers of the Department of Justice under the People's Committee of provinces and centrally-administered cities, and the functions, tasks, and powers of the Office of the People's Council and People's Committee under the People's Committee of communes, wards, and special zones in the field of justice.

This resolution is effective from the date of issuance until February 28, 2027.

In the event that a law enacted by the National Assembly is amended, supplemented, or newly promulgated and takes effect after the date this Resolution is adopted and before March 1, 2027, the corresponding provisions issued in this Resolution shall cease to be in effect.
