
Draft Decree amending the law on alcohol business
The Department of Domestic Market Management and Development ( Ministry of Industry and Trade ) informed that the Draft Decree amending and supplementing a number of articles of Decree No. 105/2017/ND-CP of the Government on alcohol trading was amended and supplemented by Decree No. 17/2020/ND-CP of the Government on amending and supplementing a number of articles of the Decrees related to investment and business conditions under the state management of the Ministry of Industry and Trade in the direction of simplifying procedures, strongly decentralizing and reducing compliance costs for businesses focusing on a number of new points.
Specifically, decentralizing licensing authority and shortening the time to handle administrative procedures. Liquor distribution licenses transfer authority from the Ministry of Industry and Trade to the provincial People's Committee. Registration, notification of retail sales and on-site alcohol sales transfer to the commune-level People's Committee (reducing the intermediary role of the district level). Licensing time is reduced from 7 days to 5 days for many procedures (re-issuance (lost/damaged), issuance of amendments, and additions to licenses).
At the same time, abolish the business type of “wholesale” of alcohol and related procedures. The draft abolishes regulations on alcohol wholesale, including abolishing the Conditions for alcohol wholesale; Documents for granting alcohol wholesale licenses; Abolishing provisions on rights, obligations, procedures, license storage, and forms related to wholesale.
In addition, the alcohol distribution license is valid nationwide; reducing conditions and procedures for licensing. The draft amendments are aimed at creating maximum conditions for businesses. Simplifying distribution conditions: The distribution system has 2 business locations or 2 traders with an Alcohol Distribution License, Alcohol Retail License. Documents are only required for alcohol suppliers in the case of alcohol imports, not required for domestic alcohol suppliers because they are managed in the issued license.
Abolish the requirement to provide a Business Registration Certificate and other documents of equivalent legal value. Abolish the regulations on labeling of goods with conditions and procedures for granting alcohol production licenses... In particular, the authority to grant industrial alcohol production licenses is regulated by the provincial People's Committee. Draft amendments to the general regulations on the authority to grant industrial alcohol production licenses (not divided by scale of 3 million liters/year) to the provincial People's Committee to unify the Law on Organization of the Government No. 63/2025 and the Law on Organization of Local Government No. 65/2025.
In addition, the draft Decree amends the forms, reporting regime, and coordination of competent State agencies (organizations, individuals, production and business enterprises, Commune People's Committees, Provincial People's Committees, Ministry of Industry and Trade) in the field of alcohol business in accordance with regulations on decentralization, delegation of authority and division of authority, the Law on Prevention and Control of Harmful Effects of Alcohol and Beer and sub-Law documents.
