Resolutely fight against, prevent, and repel smuggling, counterfeit goods, and intellectual property infringement.

The Ministry of Finance has advised the Government to issue Resolution No. 397/NQ-CP on the Action Plan to combat, prevent, and repel smuggling, trade fraud, counterfeit goods, and intellectual property infringement until 2030. This is considered a strong step, demonstrating a determination to wage an "uncompromising war" against violations, aiming to protect the rights of citizens and businesses, while maintaining social order and safety.

Many smuggling and counterfeit goods production rings have been dismantled.

On December 9, 2025, the Customs Department issued a notice on the propaganda work to implement Resolution No. 397/NQ-CP. According to the Customs Department, implementing Official Dispatch 65/CD-TTg and Directive 13/CT-TTg, with the participation of the entire political system, the functional forces have coordinated closely and synchronously in all localities and fields. The campaign has mobilized maximum intelligence, resources and combined strength in attacking and suppressing crime.

The results showed many positive changes: a series of smuggling, production and trading lines of counterfeit goods were discovered and destroyed. Notable cases were cases related to fake medicines, fake milk, fake functional foods, fake cosmetics, and foods of unknown origin; such as the production and advertising of fake milk by Rance Pharma, Hacofood, and ZHolding; the production of fake functional foods by Herbitech and Mediphar Technology Co., Ltd.; the production and trading of fake medicines and disease prevention products in Thanh Hoa and many other provinces; the false advertising of Kera vegetable candy; or the production of cooking oil for human use by Nhat Minh Food Company...

According to assessments, the perpetrators exploited loopholes in policies and law enforcement to commit violations, causing serious impacts on the economy and society, consumer rights, and public trust.

Nationwide, the Customs Department has deployed synchronous professional measures to strongly attack smuggling, trade fraud and counterfeit goods. The dismantling of many large networks shows a clear change in law enforcement, while strengthening the trust of people and businesses.

Vigorously implement the action plan until 2030.

Based on the results achieved, the Ministry of Finance and the Customs Department advised the Government to issue Resolution No. 397/NQ-CP dated December 5, 2025. The plan aims to resolutely prevent, combat, and eventually end smuggling, trade fraud, counterfeit goods, and infringement of intellectual property rights. In addition, the task of protecting the legitimate rights of people and businesses; protecting public security and health; and contributing to promoting sustainable economic growth is identified as a focus.

According to the Resolution, institutional improvement will be promoted, along with the building of a strong enough apparatus, clearly defining the functions and powers between ministries, branches and localities. The plan also emphasizes the role of people and businesses, aiming to create a strong change in awareness and sense of law compliance.

One of the important requirements is to build a team of cadres, civil servants and public employees with professional ethics, capacity and integrity in performing public duties. 100% of cadres must meet the requirements of responsibility, not be influenced or manipulated; at the same time, strictly handle cases of covering up and assisting in violations with the spirit of "no tolerance, no forbidden zones, no exceptions".

The plan also aims to ensure that 100% of anti-smuggling enforcement agencies are equipped with and apply modern science and technology in managing, monitoring, and controlling goods; and to ensure sufficient resources in terms of finance, equipment, data, and digital transformation infrastructure.

Resolution No. 397/NQ-CP identifies eight key tasks by 2030, including: perfecting institutions; strengthening inter-sectoral coordination; promoting technology application; tightening inspection and control; promoting communication; mobilizing the participation of businesses and people; expanding international cooperation... to create substantial and sustainable changes in preventing smuggling and counterfeit goods.

The resolution clearly demonstrates the government's determination to protect the rights of citizens and businesses, maintain a healthy business environment, and ensure economic security in the face of increasingly complex challenges from smuggling and trade fraud.
