The Government has just issued Resolution No. 397/NQ-CP on the Government's Action Plan to combat, prevent and repel smuggling, trade fraud, counterfeit goods and intellectual property infringement by 2030.
The general objective of the plan is to resolutely prevent, combat, stop, repel, and eventually end and eradicate smuggling, trade fraud, counterfeit goods, and intellectual property infringement with a spirit of determination, fierceness, and "uncompromising declaration of war" against smuggling, trade fraud, production, trading, and sale of counterfeit goods, poor quality goods, goods of unknown origin, and goods that infringe intellectual property rights...
Resolution No. 397/NQ-CP of the Government also clearly stated the need to promote institutional improvement; perfect the organization and apparatus to be strong enough, and specifically define the functions, tasks, and powers of ministries, branches, and local authorities at two levels. Create a strong change in awareness so that all levels, branches, people, and businesses voluntarily and well comply with the Party's guidelines and the State's laws and policies in combating smuggling, trade fraud, counterfeit goods, and infringement of intellectual property rights...

Along with that, on December 5, the Steering Committee 389 of the Ministry of Industry and Trade also issued Document No. 9693/KH-BCĐ389 on the Plan for the peak period against smuggling and trade fraud before, during and after the Lunar New Year of Binh Ngo in 2026. Accordingly, the peak period of the fight against smuggling, trade fraud and counterfeit goods will be deployed in the last month of 2025 and before, during and after the Lunar New Year of Binh Ngo in 2026 to strengthen detection, prevention and strict handling according to the provisions of law of acts of smuggling, trade fraud, production and trading of counterfeit goods, poor quality goods, goods infringing intellectual property rights and other acts in commercial activities, resolutely destroy chains, groups, hot spots, not allowing the formation of complex violation hotspots; create clear changes to repel violations, improve the effectiveness and efficiency of state management and strengthen social trust.
Also on December 5, Minister of Industry and Trade Nguyen Hong Dien signed Document No. 3564/QD-BCT approving the direction of the 2026 inspection program of the Market Management force. The 2026 inspection program of the Market Management force aims to ensure compliance with the law by organizations and individuals doing business. Effectively combat smuggling, trade fraud, counterfeit goods, and goods infringing intellectual property rights to contribute to developing domestic production, stabilizing the market, expanding trade in goods and services. The Decision also clearly assigned tasks to units under the Industry and Trade sector and localities in carrying out market inspection and control work.
Most recently, on December 8, Deputy Prime Minister Bui Thanh Son - Head of the National Steering Committee against smuggling, trade fraud and counterfeit goods, signed document 176/KH-BCĐ389 promulgating the Plan for the peak period against smuggling, trade fraud and counterfeit goods before, during and after the Lunar New Year 2026...
Thoroughly grasp key tasks and solutions
In recent times, the authorities and localities have discovered and handled many cases of law violations. However, the situation of smuggling, trade fraud, violations of the law on production and trade of counterfeit goods, goods infringing intellectual property rights, goods violating product labels, trading in expired goods, goods of unknown origin, smuggled goods, without invoices or documents is still complicated...
To effectively combat smuggling, trade fraud, and counterfeit goods, many key solutions have been proposed by the Government, the National Steering Committee 389, the Ministry of Industry and Trade, and other ministries and branches, in conjunction with regulations, human resources, coordination, and application of science and technology.
Accordingly, the first solution is to promote institutional improvement; perfect the organization and apparatus to be strong enough, and define specific functions, tasks, and powers. Mobilize the strength of the entire political system, the strength of the people and businesses to participate in the fight against smuggling, trade fraud, counterfeit goods, and infringement of intellectual property rights.
Along with that, building a team of cadres, civil servants and public employees with professional ethics and high responsibility in the process of performing public duties to ensure adequate capacity, integrity, and freedom from influence and manipulation, while strictly handling cases of cadres covering up and abetting violations with the spirit of "no tolerance, no forbidden zones and no exceptions". Strengthening the inspection, examination and supervision of licensing agencies and organizations, conformity assessment organizations to issue conclusions and results of state inspections on standards, regulations and quality of goods and strictly handling violations.
Improve the effectiveness of coordination between ministries, branches, localities, and local authorities at two levels to synchronously and effectively implement the work of preventing smuggling and illegal transportation across the border from border areas and border gates into the inland.
