Was it ignorance or deliberate intent?
On August 15, 2023, Mr. NVT, born in 1982 and residing in Hoang Son village, Thai Duong commune (Binh Giang district), was fined by the Hanoi City Police for driving a motorbike with a blood alcohol concentration exceeding 0.4 milligrams/liter. In addition to the fine, Mr. T. also had his A1 driver's license revoked for 23 months, from August 23, 2023, to July 23, 2025. Despite his license being suspended, on March 27, 2024, Mr. T. went to the Provincial Public Administration Service Center to report the loss of his driver's license and requested a reissue from the Provincial Department of Transport. After checking information with relevant authorities, the Department of Transport sent a letter to the Traffic Police Department of the Hanoi City Police, and the response from this unit exposed Mr. T.'s fraudulent behavior.
On June 17, 2024, the Hai Duong Department of Transportation issued a decision to revoke and cancel Mr. NVT's driver's license for a period of 5 years, from June 17, 2024 to June 17, 2029.
Similarly, on May 18, 2023, Mr. NVĐ, born in 1988, residing in Phu Loc village, Cam Vu commune (Cam Giang district), drove his car into a restricted area and was issued a violation report by officers of the Traffic Police and Order Team, District 11 Police ( Ho Chi Minh City). On May 24, 2023, District 11 Police issued a decision to fine Mr. Đ. 2.5 million VND and imposed an additional penalty of revoking his driver's license for 2 months, from May 24, 2023 to July 24, 2023.
The fine wasn't heavy, and the license suspension was only two months, but this man, acting like a stubborn fool, refused to comply more than a year after being fined. On February 5, 2024, Mr. D. went to the Hai Duong Provincial Public Administration Service Center to report the loss of his driver's license and submitted an application for a replacement. However, "a thin veil cannot hide the truth," and the Hai Duong Department of Transportation revoked and canceled his original driver's license, simultaneously banning him from driving for five years, from May 21, 2024, to May 21, 2029.
Take strict action.
According to the Department of Transportation, cases of fraudulent declarations like those of Mr. T. and Mr. D. have been quite common recently. On average, the Department of Transportation reissues approximately 300 driver's licenses each month. In just six months of 2024, the Hai Duong Department of Transportation revoked driver's licenses in eight cases of fraudulent declarations of lost licenses to obtain reissues, and is currently investigating nearly 10 other cases. In 2023, the Hai Duong Department of Transportation revoked driver's licenses in six cases.
Among those who falsely report the loss of their driver's license to obtain a new one, some intentionally violate the law, while others do so due to a lack of understanding or are instigated by others who believe that if they violate the law and have their license temporarily confiscated or revoked in another province, they can apply for a replacement in their local area because the licensing authority may not have their information.
According to regulations, those who falsely report the loss of their driver's license in order to obtain a replacement will face severe penalties. Therefore, the Department of Transportation requests that citizens whose driver's licenses are temporarily confiscated or revoked by authorities due to traffic violations absolutely not listen to incitement or make false reports of loss to request a replacement license.
According to Mr. Vu Duc Hanh, Deputy Director of the Hai Duong Department of Transport, all information regarding the temporary suspension or revocation of driver's licenses due to traffic safety violations is currently posted on the violation information pages of the Traffic Police Department, Ministry of Public Security, and the Road Department, Ministry of Transport. Furthermore, according to current regulations, when issuing administrative penalty decisions related to the temporary suspension or revocation of driver's licenses, the relevant authorities must notify the licensing authority, the Department of Transport. Therefore, the licensing authority has complete information on violations and the temporary suspension or revocation of driver's licenses of citizens nationwide.
Circular 05/2024/TT-BGTVT of the Ministry of Transport amends and supplements a number of articles of circulars related to the field of transport.
Road transport, road transport support services, and regulated vehicles. Drivers who commit fraud to obtain a driver's license will have their licenses revoked. Those who violate the law will be held accountable and will not be granted a driver's license for a period of 5 years from the date the violation is discovered. If they need to renew their driver's license, they must retake the driving course and examination as if they were applying for a license for the first time.
