Using images of doctors to advertise dietary supplements is a violation of the law.
Representative Khang Thi Mao ( Yen Bai Provincial National Assembly Delegation) asked the Minister of Health whether it is in accordance with regulations for individuals wearing white coats and claiming to be hospital doctors to advertise functional foods. If it is illegal, what penalties will be imposed?

Minister of Health Dao Hong Lan stated that advertising related to medicines, functional foods, pharmaceuticals, and cosmetics is now fully regulated by relevant laws. The current amended Advertising Law, as well as its implementing regulations and guidelines, clearly stipulates that the use of images of doctors, medical practitioners, or medical facilities in advertising is prohibited. The Penal Code also clearly defines the levels of criminal penalties for violations of advertising laws.
Therefore, the Minister affirmed that the use of these images is against regulations. The Ministry of Health has sent a document to all Departments of Health and medical facilities nationwide to remind and request that every official and employee in the health sector refrain from participating in advertising that violates regulations.

What are the solutions to limit brain drain to the private sector?
Participating in the questioning session on health-related issues, National Assembly representative Nguyen Thi Yen Nhi (Ben Tre province) raised the issue that, in recent times, after receiving training, many doctors have not worked as assigned by competent authorities or have not fulfilled their commitments, readily moving to work in private hospitals. This has affected opportunities, state budget, and personnel allocation in public health facilities. The representative requested the Minister of Health to provide his views and solutions to mitigate this situation in the future.
Responding to this issue, Minister of Health Dao Hong Lan affirmed that from the beginning of 2021 to June 2022, the situation of healthcare workers resigning became serious, with more than 9,000 people leaving their jobs.

Following the pandemic, the Ministry of Health has implemented numerous solutions to address this situation. These include revising decrees on allowances and incentives for healthcare workers; amending decisions related to the benefits for village healthcare workers, etc. Simultaneously, localities are also actively assessing the utilization of public healthcare personnel.
According to Minister Dao Hong Lan, public healthcare workers account for up to 95% of the workforce serving the people, playing a very important role. However, without appropriate policies and effective solutions, attracting and retaining healthcare workers will be difficult, leading to a brain drain to private healthcare facilities.
There is also the situation where one practitioner is in charge of multiple medical examination and treatment facilities.
National Assembly representative Nguyen Thi Kim Thuy (from the Da Nang City National Assembly delegation) reflected that, recently, voters in the healthcare sector have been very concerned about the location where medical practice licenses are issued. Practitioners can submit applications for licenses in any locality, leading to a situation where one person holds multiple licenses and may be responsible for the technical expertise of multiple medical facilities across different provinces and cities.

The delegate requested that the Minister of Health implement management measures to ensure that each practitioner is granted only one practice license and is registered under only one medical examination and treatment facility, as stipulated by law.
In response to this question, Minister of Health Dao Hong Lan stated that the implementation of regulations in the amended Law on Medical Examination and Treatment, as well as Decree 96/ND/CP related to the issuance of practice licenses, has stipulated that each practitioner can only have one license. Currently, we are moving towards nationwide management of the use of practitioner licenses. The Minister said that previously, the Ministry of Health had a software system for managing medical practitioners nationwide, and to date, 430,000 practitioners have been included in the management system out of a total of over 600,000 practitioners nationwide.

In addition, the Minister of Health also stated that this system was built in 2015 on the basis of a closed system, so updating, managing, and using it must comply with the spirit of Decree 96/ND-CP and the Law on Medical Examination and Treatment of 2023. The Ministry of Health is adjusting the content to upgrade this software and will connect it with the online public service systems of localities, as well as the national online public service system. At the same time, the Ministry of Health is also implementing solutions to have a unified system nationwide.
"At that time, leaders at all levels and local health authorities can all refer to and understand information about practitioners in order to manage them according to regulations," said Minister of Health Dao Hong Lan.
