(NLDO) - The Ministry of Health details the conditions for surrogacy and the transfer of sperm, eggs, and embryos, and adds health standards.

The Ministry of Health has just issued Circular 38/TT-BYT detailing a number of articles of Decree 207/2025/ND-CP on giving birth using assisted reproductive technology and conditions for surrogacy for humanitarian purposes. The Circular takes effect from October 1, 2025.

Circular regulating health standards for sperm, egg and embryo recipients; regulations on sample delivery and receipt between storage facilities; minimum list of in vitro fertilization techniques; data management, statistical reporting and information sharing.

The head of the facility performing in vitro fertilization or a legally authorized person is responsible for organizing and conducting examinations, consultations, and concluding on health conditions to receive sperm, eggs, and embryos according to regulations.

Recipients of sperm, eggs, and embryos must not have diseases that cause infertility, endanger life during pregnancy, or mental illness that affects cognition and behavior. Those with acute illnesses must postpone embryo transfer until stable.

The facility performing in vitro fertilization (IVF) is responsible for examining, consulting and confirming health eligibility according to regulations.

Regarding sample delivery and receipt, the Ministry of Health guides consulting facilities, agrees in writing and carries out safe sample transportation, with the participation or legal authorization from the donor and recipient. Samples must be frozen, sealed, and accompanied by documents according to regulations. Transportation costs are paid by the sender or recipient of the sample.

This Circular also abolishes relevant chapters in the previous Circular 57/2015/TT-BYT and guides the application of new documents if there are any amendments or supplements.
