Notably, Regulation 377 of the Politburo clearly states that cadres who have committed violations, shortcomings, or have been disciplined or are in the process of investigation, inspection, examination, settlement of denunciations, complaints, or consideration of responsibility can be considered for planning higher positions if they ensure the standards and conditions according to regulations in 3 cases.

The third case is being disciplined by reprimand or warning after the disciplinary period has expired.
The Politburo noted that Party committees, Party organizations, and collective leadership of agencies and units should base on the situation of cadres and task requirements to analyze and evaluate objectively, cautiously, thoroughly, and consider many aspects of each case to consider and decide according to their authority or report to competent authorities for consideration before planning.
The factors considered are the quality, capacity, reputation, work product results of the personnel; the cause, motive for the violation, shortcomings (objective, subjective) and the nature, extent, impact, influence, and results of remediation (if any)...
For officials who have information exchanged by competent authorities about personal responsibility in cases, incidents, and conclusions that competent authorities have investigated, inspected, and examined but have not yet had an official conclusion, or have a request from competent authorities to consider and handle personal responsibility..., the Politburo stipulates that "temporarily not consider planning".
The Politburo also stated that there is no planning for cadres who are in the process of handling denunciations (there is a decision to establish a denunciation handling team), disciplinary complaints, being inspected when there are signs of violations or being considered for disciplinary action; cadres who are in the disciplinary period.
Cadres who are concluded by competent authorities to have violated political views, principles of Party organization and activities, sought positions and power in personnel work, taken advantage of positions and powers for personal gain, regulations on exemplary responsibility, negatively affected the reputation of the Party organization and caused public outrage, will also not be planned.
Cadres planned for the next term must be of working age for more than 2 terms.
Regulation 377 clearly states that the planned positions include: Central Party Committee member, Politburo member, Secretariat member; positions under the management of the Politburo and Secretariat and positions that must be evaluated by central party committees and agencies; positions under the direct management of party committees, party organizations, and collective leadership of agencies and units.
The Politburo also clearly stipulates methods, standards, conditions, and planning ages.
In particular, cadres planned for the next term must be old enough to work for 2 terms or more, at least 1 full term (60 months). When reviewing and supplementing the annual planning for the current term, cadres included in the planning must be old enough to work for at least 60 months or more.
According to the regulations of the Politburo, the structure and proportion of planning for Party committees and leadership and management positions strive to: Young cadres (under 47 years old for central agencies; under 42 years old for provincial and communal levels) from 15% or more, female cadres from 25% or more. Cadres with scientific and technological qualifications are about 5-10%, the proportion of ethnic minority cadres is appropriate for each locality and field.
Cases that are automatically out of the planning, according to Regulation 377, include: Cadres who have been appointed or elected to a planning position; cadres who are over the age of appointment; have been disciplined by competent authorities from the form of reprimand or higher (for individuals) or concluded by competent authorities to not ensure the political standards of the planning position; cadres who have been dismissed from their positions by competent authorities, resigned, or dismissed from their positions; cadres who have passed away or retired...
