Da Nang removes obstacles to help the project restart

Many projects are cleared

The Department of Agriculture and Environment of Da Nang has just approved the issuance of a land use right certificate for the Dragon City - Park Green Urban Area Project, invested by Saigon - Da Nang Investment Joint Stock Company. This project was approved for a detailed 1/500 plan in 2011, with an area of 78.3 hectares; by 2019, it was adjusted to nearly 70 hectares for resettlement.

The problem arose because the City determined the land price and allocated land when the site had not been cleared and there was no decision on land allocation. The Da Nang Land Management and Exploitation Company also allocated land and collected land use fees without auction, which was against the regulations. However, the Government Inspectorate concluded that it did not require the cancellation of land allocation decisions, but only requested that this type of land allocation be stopped. The current issuance of land use right certificates helps speed up procedures for the project.

Dragon City - Park is just one of many projects that have been unstuck after applying Resolution 170/2024/QH15 of the National Assembly "Special mechanisms and policies to remove difficulties and obstacles for projects and land in the conclusions of inspections, examinations, and judgments in Ho Chi Minh City, Da Nang City, and Khanh Hoa Province" (Resolution 170).

To date, Da Nang has collected VND1,470/2,308 billion into the budget according to Conclusion 2852 of the Government Inspectorate, including similar reviewed projects. The city also decided to recover 5-10% of land use fees in hundreds of cases, transferring the tax authority to notify financial obligations.

At the same time, handle and adjust the land use term on the land use right certificate for 692/1,313 cases of violation, currently 621 cases are still being handled.

Regarding related projects, the Public Security Agency has concluded not to prosecute the case at the Ghenh Ban - Bai Da Tourist Area Project and Lot L09. Regarding the Suoi Da Villa Area - Lot L09, Da Nang has reclaimed an area of 7,431 m2 due to land allocation to the wrong subjects. The city is also directing the review and guidance on completing legal procedures for other projects.

Proposal to expand the application of Resolution 170

After receiving instructions from the Central Government, Da Nang has promptly implemented specific mechanisms and policies, bringing positive results and clarifying the legal basis for many projects. However, the adjustment of the Planning of Da Nang City and Quang Nam for the period 2021-2030, with a vision to 2050 according to Resolution No. 202/2025/QH15 on the arrangement of provincial-level administrative units, including the merger of two localities, has made it difficult to complete land procedures for 13 projects on Son Tra Peninsula within 12 months according to Decree No. 76/2025/ND-CP of the Government.

In addition, the determination of land prices for similar projects also gives rise to many more cases such as Non Nuoc Beach Resort, Silver Shores, Hoang Cuong... Da Nang City proposes to allow the application of Article 7, Resolution 170/2024/QH15 and Decree 76/2025/ND-CP to re-determine land prices, both ensuring the budget and removing difficulties for investors.

Regarding the adjustment of land use term, in addition to the 1,313 cases initially reviewed, the City expects to have many more similar projects. Therefore, it is proposed to allow the application of the principle of adjusting land term to 50 years, in accordance with Resolution 170 and Decree 76.

Speaking at the working session with Da Nang, Deputy Prime Minister Nguyen Hoa Binh highly appreciated the results of implementing Resolution 170 in Da Nang, emphasizing that this will be the basis for expanding its application nationwide.

“The National Assembly issued Resolution 170 allowing its implementation in Da Nang, Ho Chi Minh City, and Khanh Hoa province, but the general situation across the country is that many projects are facing similar difficulties. Quang Nam also has many projects facing similar difficulties and problems, but after July 1, when merging with Da Nang, Resolution 170 of the National Assembly will be applied immediately according to Da Nang’s mechanism. Therefore, before expanding the application of Resolution 170, it is necessary to summarize what has been and has not been done, as a basis for implementation,” Deputy Prime Minister Nguyen Hoa Binh emphasized.
