The Ministry of Finance is seeking opinions on a draft decree on land use fees and land rents to remove obstacles in implementing the Land Law.
According to the draft, when households and individuals change the purpose from agricultural land to residential land within the local residential land allocation limit, the land use fee is only 30% of the difference between the land use fee calculated based on residential land price and agricultural land price at the time the competent authority permits the change of purpose.
For the area exceeding the limit but not more than once the limit, the land user must pay 50% of the difference. In case the area exceeds the limit once, the collection rate will be 100% of the difference between the land use fee calculated based on the price of residential land and agricultural land.
This preferential policy is only applied once for each household or individual on a plot of land. Subsequent conversions will require payment of 100% of the difference according to regulations.
Meanwhile, according to the provisions of the 2024 Land Law, the fee for converting agricultural land to residential land is the difference between the price of residential land and the price of agricultural land. Thus, people will have to pay the entire difference, 100%.
Furthermore, in reality, agricultural land prices are very low, while residential land prices according to the land price list announced by many localities from 2025 have increased. Therefore, many people cannot convert the purpose of use from agricultural land to residential land.
Recently, voters in Ho Chi Minh City, Da Nang , etc. simultaneously sent documents to the National Assembly's Petition and Supervision Committee, requesting a reduction in land prices and fees for converting agricultural land to residential land for people.
Voters reported that many people cannot convert land use to residential land because the amount of money they have to pay is too large.
Voters in Ho Chi Minh City believe that current land prices are not suitable for the lives and incomes of people, especially low- and middle-income workers. At the same time, some households in difficult circumstances have divided land plots to build houses for their children but do not have enough financial capacity to change the purpose of land use rights to residential land.
Therefore, voters recommend considering appropriate land use conversion fees.
Voters in Da Nang also reflected that the tax, fee, charge and land use fee when carrying out procedures to transfer land use rights are too high, beyond the capacity of many people, causing difficulties in exercising legal rights regarding housing, production and business.
Voters proposed reducing tax, fee, charge and land use fee policies in the direction of reducing land prices by 20-30% compared to present, in accordance with socio-economic conditions and financial capacity of the people.
