Illegal construction of warehouses is rampant, with signs of cover-up.

On October 25th, sources from Thanh Nien newspaper confirmed that Mr. Le Hung, Deputy Director of the Dak Lak Department of Construction, had signed and issued an inspection report, which pointed out many shortcomings and limitations in the management of construction order in Krong Pak District, Dak Lak Province.

Previously, the Dak Lak Department of Construction established inspection team 169, coordinating with relevant units to conduct random inspections of 32 out of 632 construction projects in 6 communes and towns along National Highway 26.

During the inspection, the team discovered that 31 out of 32 construction projects violated legal regulations in the fields of construction and land use (accounting for 97%). Of these, 18 out of 32 projects have not yet been dealt with, and 14 out of 32 projects have had administrative violations processed.

The Dak Lak Department of Construction believes that the People's Committee of Krong Pak District and its communes and towns lack responsibility in monitoring, detecting, inspecting, handling, and promptly notifying competent authorities to organize inspections and handling from the very beginning of construction projects.

According to the Dak Lak Department of Construction, the People's Committee of Krong Pak District, communes, and towns are compiling dossiers to handle violations, but this is only done for projects invested in by private enterprises and individuals.

Meanwhile, large-scale construction projects undertaken by limited liability companies and joint-stock companies are not inspected or documented for violations as required by regulations, causing inequality and affecting public trust in the government at all levels and the strictness of the law.

The Dak Lak Department of Construction also stated that the Krong Pak District People's Committee lacked decisiveness and thoroughness, focusing only on collecting fines, resulting in 14 out of 32 violating constructions (for which administrative penalties have been issued) failing to rectify the consequences as required.

There are signs of concealment and cover-up of illegal constructions.

During the inspection, the People's Committee of Krông Pắk District reported that 6 communes and towns had submitted lists of construction projects. The remaining 10 communes and towns did not report any construction projects in their areas. The Dak Lak Department of Construction believes that this shows signs of concealing or covering up violations.

According to the Dak Lak Department of Construction, most of the illegal constructions in Krong Pak District are warehouses and workshops used for purchasing and processing durian. Because of the high value and profits from durian, many organizations and individuals disregard the law and construct illegal buildings.

The Dak Lak Department of Construction has assessed that many durian processing warehouses in Krong Pak District are in violation of construction regulations.

The Dak Lak Department of Construction believes that state management of construction order in Krong Pak District has not received adequate attention. The number of officials and civil servants assigned to manage construction order is insufficient, their professional skills are limited, and their knowledge is not in-depth. Furthermore, local authorities are hesitant to implement remedial measures.

Furthermore, developers who have committed violations often deliberately evade or delay compliance with administrative penalty decisions, such as delaying payment of fines or failing to rectify the consequences by demolishing the illegal structures.

Based on the above opinions, the Dak Lak Department of Construction recommends that the People's Committee of Krong Pak District conduct a review of the responsibilities of individuals and units involved in managing construction order within their jurisdiction.

At the same time, direct specialized departments and communes/townships to prepare dossiers for handling and advising on the definitive resolution of construction violations in their areas of management that the inspection team has pointed out, in accordance with the law.

Regarding the assessment by the Dak Lak Department of Construction on the aforementioned violations of construction and land regulations in Krong Pak District, a Thanh Nien reporter repeatedly called a leader of the Krong Pak District People's Committee, but this person did not answer the phone.
