(CLO) Professor Pham Hong Chuong, Rector of the National Economics University (NEU), proposed a study to consider piloting the decentralization of authority to decide on the adjustment of commercial housing construction projects to social housing projects for provincial People's Committees.
Currently, the National Assembly has passed three laws related to the real estate market: the Housing Law 2023, the Real Estate Business Law 2023, and the Land Law 2024. These laws, along with their implementing guidelines, officially came into effect and were implemented on August 1, 2024 (5 months earlier than previously stipulated).
For these three laws to be effectively implemented and truly serve as effective tools for developing a stable, sustainable, and healthy real estate market, contributing to macroeconomic stability and achieving major economic balances, Professor Pham Hong Chuong, Rector of NEU, believes that the role of state management agencies and the awareness of market participants are extremely important.

According to Mr. Chuong, there are still many difficulties in accessing land for investment projects in localities. Many projects are hampered by issues related to land acquisition, compensation, site clearance, difficulties in converting land use purposes, and land use planning for investment projects…
Therefore, according to him, solutions should focus on addressing the specific problems and obstacles faced by businesses.
Firstly, it is necessary to improve the auction, bidding, and land allocation processes in accordance with the new regulations of the Law, to ensure that investment projects with completed infrastructure and sufficient legal conditions can be implemented in accordance with the regulations.
Secondly, the state needs to develop and adjust land price tables in accordance with the spirit of the new law, but it must ensure a balance of interests between the State and investors so that businesses have a basis for fulfilling their financial obligations to the State and management agencies have a basis for approving projects.
Thirdly, expedite the completion of legal procedures and remove obstacles for projects, in order to facilitate the transfer of projects to those lacking sufficient financial capacity as required by the 2023 Real Estate Business Law;
Fourth, allow for the adjustment and guidance of the process for converting commercial housing projects into social housing for rent or lease-to-own for eligible policy beneficiaries;
Fifth, Professor Pham Hong Chuong proposed researching and considering a pilot program to decentralize the authority to decide on the adjustment of commercial housing construction projects to social housing projects to the People's Committees of provinces/cities in order to accelerate the restructuring of real estate products in the market.
