On the afternoon of May 28, the National Assembly held a plenary session in the hall to discuss a number of controversial contents of the draft Law on the Capital (amended).
No People's Council is organized in wards of districts and towns.
Presenting a summary report on some major issues in explanation and acceptance, Chairman of the National Assembly's Law Committee Hoang Thanh Tung said that the draft Law on the Capital has been reviewed and revised in the direction of rearranging the order of some articles and clauses to ensure they are more logical and appropriate.
According to Mr. Tung, based on the opinions of the National Assembly Deputies, the draft Law has been accepted and revised in the direction of only regulating specific mechanisms and policies.
In particular, it demonstrates strong decentralization for the Hanoi city government but at the same time also places higher responsibility on the City government in building, protecting and developing the capital, without re-stipulating the contents and issues that have been stipulated in other laws, especially the laws recently passed by the National Assembly such as the Land Law and the Housing Law.

Regarding the model of government organization in Hanoi, Mr. Tung said that the urban government model in Hanoi defined in the draft Law on the Capital (amended) is built on the basis of inheriting the provisions of Resolution No. 97 dated November 27, 2019 of the National Assembly on piloting the organization of the urban government model in Hanoi.
"Accordingly, there will be no People's Councils in wards of districts, towns, and cities in Hanoi," said Mr. Tung.
Regarding the contents of decentralization for Hanoi city related to organizational structure and staffing, based on the opinions of National Assembly deputies, the draft Law was accepted and revised in the direction of strong decentralization and delegation of power to Hanoi city.
"Help the City government be more proactive in organizing its apparatus and staffing to effectively undertake its very special role and task as the capital of the Socialist Republic of Vietnam," said the Chairman of the Law Committee.
Authorized to approve construction projects on riverbanks
Regarding the construction, development, management and protection of the Capital, the Hanoi People's Committee is allowed to locally adjust the general urban planning, the general planning for the construction of functional areas, and the specialized planning of the technical infrastructure of the City.
Decentralize the authority to the City People's Committee to approve construction projects on river banks and floating banks on diked rivers in the City, ensuring conditions according to the provisions of the law on dikes (Clause 6, Article 18).
Stipulate the principles of management and use of underground space in the City, requirements for functional zoning to manage, exploit and use underground space and assign the Government to prescribe the depth limit that land users are allowed to use.

Allow public universities, public vocational training institutions, and other public scientific and technological organizations in the City to establish or participate in establishing enterprises to commercialize scientific research results and technological development under the intellectual property rights of such institutions and organizations.
Decentralize the authority to the City People's Committee to decide on the establishment and expansion of high-tech zones; promulgate regulations on the operation of high-tech zones established by the City People's Committee; prescribe a number of specific mechanisms for public service units in high-tech zones, including mechanisms applicable to the National Innovation Center located in Hoa Lac High-Tech Park.
Expand the areas in which the City People's Council is allowed to prescribe higher administrative fines and apply them throughout the city, regardless of inner city or suburbs.
Supplementing some authority to the City People's Council and People's Committee in deciding and implementing some solutions on developing culture, sports, tourism, education, training, healthcare, science and technology, innovation, digital transformation, environmental protection, agriculture, rural areas and urban renovation and beautification...
The report summarizes some major issues in explaining, accepting and revising the draft Law on the Capital (amended) and also accepts delegates' opinions related to finance, budget and resource mobilization for the development of the Capital.
Accordingly, the draft Law was received and revised in the direction of supplementing and clarifying a number of specific contents and measures to attract and mobilize social resources, promote innovation, and attract high-quality human resources to develop the Capital .
