According to Clause 9, Article 2 of the 2020 Law on Residence, a temporary residence is a place where a citizen lives for a certain period of time outside of his/her permanent residence and has been registered for temporary residence.

In addition, Clause 1, Article 27 of the 2020 Law on Residence stipulates that the condition for temporary residence registration is that citizens who come to live at a legal residence outside the commune-level administrative unit where they have registered for permanent residence to work, study or for other purposes for 30 days or more must register for temporary residence.

Article 9, Clause 1 of Decree 144/2021/ND-CP provides for penalties for violations of regulations on registration and management of residence as follows:

A fine of between VND 500,000 and VND 1,000,000 shall be imposed for one of the following acts:

Failure to comply with regulations on permanent registration, temporary registration, permanent registration deletion, temporary registration deletion, household separation or adjustment of residence information in the Residence Database.

Failure to comply with regulations on notification of residence and temporary absence declaration.

Failure to present household registration book, temporary residence book, confirmation of residence information, or other documents related to residence as required by competent authorities.

Thus, in case of failure to comply with regulations on temporary residence registration, temporary residence cancellation, and temporary absence declaration, a fine of 500,000 VND to 1,000,000 VND will be imposed.

Temporary residence registration procedures

Temporary residents submit temporary residence registration applications to the residence registration office where they plan to reside.

Within 3 working days from the date of receiving a complete and valid application, the residence registration authority shall be responsible for verifying and updating information on the new temporary residence and the temporary residence period of the registrant in the Residence Database and notifying the registrant of the updated temporary residence registration information. In case of refusal of registration, a written response must be given stating the reasons.
