Nguyen Nhat Linh was born in 1982 and resided in Hung Yen commune, An Bien district, Kien Giang province (now An Bien commune, An Giang province); Tran Quoc Nam was born in 1997 and resided in Tay Yen commune, An Bien district, Kien Giang province (now Tay Yen commune, An Giang province).
According to the indictment, fishing vessels KG-90937-TS and KG-90143-TS were owned and directly managed by Truong Van Duong, born in 1975, residing in My Hiep Son commune, Hon Dat district, Kien Giang province (now My Thuan commune, An Giang province), who operated them at sea for fishing.
On February 15, 2024, fishing vessel KG-90937-TS with 14 crew members, captained by Nguyen Nhat Linh, and fishing vessel KG-90143-TS with 2 crew members, captained by Tran Quoc Nam, departed from the Kenh Dai Border Guard Control Station under the Tay Yen Border Guard Post.
Both fishing vessels are equipped with vessel tracking devices, and these devices are electronic. Linh makes the decisions regarding the operation of both vessels.

The two defendants listened as the verdict was announced.
Because fishing in Vietnamese waters was not profitable, at approximately 7:48 AM on May 17, 2024, Linh used a magnet to disable the vessel tracking device on the KG-90937-TS vessel and instructed Nam to disable the tracking device on the KG-90143-TS vessel in order to steer the two vessels through Malaysian waters to fish.
After fishing without activating their vessel tracking devices, the Coast Guard Region 4 forces discovered and ordered Linh and Nam's two fishing vessels to return to Vietnamese waters.
At approximately 4:34 PM on May 21, 2024, both were arrested by the Coast Guard Region 4 forces. On May 20, 2025, Nam and Linh were charged and investigated.
