Reorganizing and handling public assets of Vietnamese agencies abroad

Decree 171/2024/ND-CP supplements Article 5a "Rearranging and handling public assets of Vietnamese agencies abroad". It clearly states: Vietnamese agencies abroad shall review existing assets to ensure they meet the standards and norms in this Decree; on that basis, perform the following:

Assets that meet the standards and norms prescribed in this Decree shall continue to be managed and used; representative agencies, seconded units, and other agencies of Vietnam abroad that have assets shall carry out full statistics and accounting of the physical objects and values ​​in accordance with the provisions of law.

For assets exceeding standards and norms, Vietnamese agencies abroad shall report to competent agencies and persons for handling in accordance with the forms prescribed by law on management and use of public assets and the provisions of this Decree.

Decree 171/2024/ND-CP also supplements Article 12a "Transfer of working headquarters, career facilities, residences, and private homes of Ambassadors".

Accordingly, the transfer of the Ambassador's office, business premises, residence, and private residence is carried out in the cases specified in Clause 1, Article 42 of the Law on Management and Use of Public Assets.

Regarding the decision-making authority, the Decree clearly states: The Minister of Finance decides to transfer the working headquarters, business establishments, residences, and private houses of Ambassadors between ministries, central agencies, between the central and local levels, between provinces and centrally run cities based on the proposal of the Minister, Head of the central agency, and Chairman of the People's Committee of the relevant provincial level.

Ministers and heads of central agencies decide or delegate authority to decide on the transfer of working headquarters, career facilities, residences and private houses of Ambassadors between agencies, organizations and units under the management of ministries and central agencies.

The People's Council at the provincial level decides or delegates the authority to decide on the transfer of working headquarters, public service facilities, and housing between agencies, organizations, and units under the management scope of the locality.

Car prices, car users of representative agencies

Decree amending Article 16 "Types, quantity, prices of cars and subjects using cars of representative agencies" as follows:

For cars serving the work of Ambassadors and equivalent positions, Charge d'Affaires, Heads of Vietnamese Delegations to international organizations are allowed to regularly use 01 car for work with a maximum price excluding taxes of 90,000 USD/car (the rate prescribed in Decree 166/2017/ND-CP is 65,000 USD/car); Consuls General and equivalent positions are allowed to regularly use 01 car for work with a maximum price excluding taxes of 85,000 USD/car (the rate prescribed in Decree 166/2017/ND-CP is 60,000 USD/car).

Based on the price level and requirements for diplomatic activities in each country and territory and the maximum car price specified above, the Ministry of Foreign Affairs decides on the appropriate type, brand and price of cars to equip cars for work for the positions specified above.

For cars serving the general work of representative agencies (except for seconded units)

According to the Decree, the positions of representative agencies, depending on specific conditions and the nature of work, are arranged cars for work purposes according to the regulations of the Head of the representative agency.

The number of staff to determine the number of cars prescribed here does not include positions that have been equipped with cars according to regulations on cars serving the work of the above positions.

In case a representative agency has merged departments, the car usage norms for the common work of the merged departments are determined according to the number of staff of each department according to the above regulations.

Regarding the price of vehicles for general work, the Decree clearly states that the maximum price of one car excluding taxes is 55,000 USD/car; the remaining cars have a maximum price excluding taxes of 45,000 USD/car.

This Decree comes into force from January 1, 2025.
