According to this resolution, Quang Nam will exempt land rent for the entire lease period of a project, up to a maximum of 50 years. This applies to projects using land for production and business purposes in investment-incentive sectors or in investment-incentive areas as stipulated in Point a, Clause 1, Article 157 of the Land Law, provided they meet one of two conditions: they are included in the list of types, scale criteria, and standards for socialized projects decided by the Prime Minister , or they are non-profit projects as stipulated by law.
In addition, land tax exemptions will be applied provided that the project complies with legal regulations on planning, investment, land, bidding, and other relevant legal regulations; the project must ensure that it is implemented according to the schedule, objectives, and investment scale as approved and certified by the competent authority; and it is implemented for the intended purpose and effectively.
Notably, in each project, only the land area used for its intended socialized, non-profit purpose is exempt from land rent. Land used for purposes other than those intended is not eligible for this exemption. Furthermore, the exemption does not apply to land used for commercial or service purposes, or land leased by the State through auction. Land users are not allowed to include the exempted land rent in the cost of products or services provided to society.
The Provincial People's Council has assigned the Provincial People's Committee to determine the purpose of land-use projects based on central government guidelines, thereby providing a basis for implementing preferential land lease fee exemptions in accordance with regulations. Simultaneously, it is to provide guidance and notification on the list of investment incentive sectors, investment incentive areas, and related regulations and procedures in accordance with the law to facilitate implementation.
Strengthen the management and use of land for socialized and non-profit projects to ensure efficiency and cost-effectiveness; regularly inspect, check, and monitor, and promptly handle investors who fail to implement projects in accordance with commitments approved and agreed upon by competent authorities.
If a project is found not to meet the conditions for receiving preferential treatment such as exemption from land rent as stipulated, it should be promptly handled or reported to the competent authority for handling, revoking the preferential treatment, and collecting financial obligations in accordance with the law.
