On the afternoon of June 22nd, with 414 out of 465 votes in favor, 28 votes against, and 23 abstentions, the National Assembly passed the Law amending and supplementing a number of articles of the Law on the People's Public Security, which will take effect from August 15th, 2023.
Accordingly, the police force now has six additional positions with the highest rank of general, including one Lieutenant General who is a seconded police officer elected to the position of Chairman of the National Assembly's Committee on National Defense and Security.
Previously, during discussions in committees and in the plenary session, some opinions suggested regulating the number of general-level positions as a percentage of the total military force; and setting an appropriate number of generals during peacetime.
Some opinions suggest that there should be no limit on the number of general-level positions. Other opinions propose adding a regulation that seconded officers elected to the position of Vice Chairman of the National Assembly should hold the highest rank of General.
In the report explaining, receiving feedback, and revising the draft law before the National Assembly voted, the Standing Committee of the National Assembly stated that the above opinions were well-founded.
However, the determination of the number of general-level positions was carefully and thoroughly considered and evaluated, placed in the overall context of the number of general-level positions in the People's Army during the drafting of the Law on the People's Public Security and the Law on Officers of the Vietnam People's Army, and was decided by the competent authority, according to the report.
The current Law on the People's Public Security stipulates 199 positions with the rank of general; each position has been specifically defined in the law and in resolutions of the Standing Committee of the National Assembly.
Thus, adding six positions with the highest rank of general completes the required number of positions as decided by the competent authority.

The Standing Committee of the National Assembly also explained that current law stipulates that the highest rank for seconded officers is Lieutenant General or Major General, and higher ranks for seconded officers are decided by the competent authority.
During the 15th National Assembly term, the Chairman of the National Defense and Security Committee was a seconded police officer, a Deputy Minister of Public Security .
Therefore, adding a provision granting the rank of General to seconded officers elected to the position of Chairman of the National Defense and Security Committee is consistent with practice and ensures uniformity and strictness in the rank classification of seconded officers.
When amending the Law on Officers of the Vietnam People's Army, consideration will be given to granting the rank of General to seconded People's Army officers elected to the position of Chairman of the National Defense and Security Committee to ensure consistency between the two laws, the report stated.
The National Assembly also agreed to amend and supplement the maximum service age for non-commissioned officers and police officers. Specifically, the maximum age is 47 for non-commissioned officers; 55 for junior officers; 57 for majors and 55 for lieutenant colonels; 60 for senior colonels; 62 for men; 60 for women; and 60 for generals.
In cases where a police unit has a need, police officers of the rank of Lieutenant, Major, Lieutenant Colonel, or Colonel, if they possess sufficient qualities, are highly skilled in their profession, have good health, and volunteer, may have their service age extended according to the regulations of the Minister of Public Security, but not exceeding 62 for men and 60 for women.
In special cases, officers may have their service age extended beyond 62 for men and beyond 60 for women according to the decision of the competent authority.
For police officers, the maximum age for service is 62 for men and 60 for women, following the retirement age roadmap for workers as stipulated in the Labor Code. Police officers are subject to the same regimes and policies as defense workers .
