On November 7th, the National Assembly continued its working session. In the morning, delegates discussed in the plenary hall the draft laws amending and supplementing several articles of the Law on Securities, the Law on Accounting, the Law on Independent Auditing, the Law on State Budget, the Law on Management and Use of Public Assets, the Law on Tax Management, and the Law on National Reserves.
Following that, the Deputy Prime Minister and Minister of Finance explained and clarified some issues raised by National Assembly deputies.
During the afternoon session, delegates discussed the draft Law on Electricity (amended) in the assembly hall. The Minister of Industry and Trade explained and clarified some issues raised by National Assembly delegates.
According to the Minister of Industry and Trade, the Electricity Law of 2004 and its amendments have established a legal framework for electricity activities and usage, protecting the legitimate interests of electricity customers and organizations operating in the electricity sector, meeting the ever-increasing demand for electricity, and contributing to the socio-economic development of the country.
However, after nearly 20 years of implementation and four amendments to several articles, the practical application of electricity law reveals several issues that the current Electricity Law does not address. Therefore, the Electricity Law needs to be amended and supplemented to meet the objectives of implementing the Party's policies on the energy sector in general and electricity in particular, especially the goal of ensuring national energy security, strengthening the division of responsibilities and decentralization, improving the effectiveness of state management of electricity, and promptly adjusting social relations arising in the practical operation and use of electricity.
The draft Law on Electricity (amended) comprises 9 chapters with 130 articles. The draft law inherits and mainly amends 62 articles concerning general regulations, licensing of electricity operations, the electricity market, electricity trading, electricity prices, rights and obligations of electricity units and electricity users, protection of electricity infrastructure, and electrical safety. The amended Law on Electricity removes 4 articles (propaganda and dissemination of legal education; application dossiers for granting, amending, and supplementing electricity operation licenses; rights and obligations of specialized electricity consulting units; and electricity inspection), merging these 4 articles into other articles (mainly concerning development policies on investment, electricity saving, and electricity prices).
The draft also adds 68 articles covering topics such as power development planning, bidding policies for power generation projects, policies for handling emergency power sources, policies for developing and operating gas-fired thermal power plants, power generation projects invested under the public-private partnership model using build-operate-transfer contracts, policies on renewable energy (solar power, especially regulations on offshore wind power development), and new energy sources with appropriate scientific and technological advancements (such as hydrogen). In addition, it includes mechanisms for direct electricity trading, full implementation of all levels of the competitive electricity market, aiming to eliminate cross-subsidization of electricity prices between economic sectors, different types of electricity prices, time-of-day electricity trading prices, and multi-sectoral electricity pricing.../.
