Procedures for building and appraising science, technology and innovation programs

The Minister of Science and Technology issued Circular 36/2025/TT-BKHCN stipulating the framework for the order and procedures for developing, appraising, promulgating, managing, and organizing the implementation of science, technology, and innovation programs and regulations on the order and procedures for considering funding, placing orders, signing contracts, organizing implementation, terminating implementation, liquidating contracts, assigning tasks, and evaluating science, technology, and innovation tasks.

This Circular provides guidance on certain provisions in Clause 2, Article 57 of Government Decree No. 267/2025/ND-CP dated October 14, 2025, which details and guides the implementation of certain articles of the Law on Science , Technology and Innovation regarding science, technology and innovation programs and tasks, and certain regulations on promoting scientific research, technology development and innovation.

The Circular applies to agencies, organizations, enterprises and individuals engaged in science, technology and innovation activities in Vietnam or outside the territory of Vietnam but have rights and obligations under Vietnamese law and international treaties to which Vietnam is a member.

Procedures for developing, appraising, promulgating, managing, and organizing the implementation of science, technology, and innovation programs

According to the Circular, ministries, ministerial-level agencies, government agencies, and other central agencies (proposing agencies) shall, based on the provisions of Clauses 1 and 3, Article 21, Clauses 1 and 2, Article 26, and Clause 5, Article 28 of Decree No. 267/2025/ND-CP, develop national science, technology, and innovation programs, special national science, technology, and innovation programs, and national science, technology, and innovation programs for strategic technology development, and submit them to the Ministry of Science and Technology for appraisal.

The Ministry of Science and Technology shall organize the appraisal according to the complete dossier prescribed in Clause 2, Article 21 of Decree 267/2025/ND-CP. Within 45 days from the date of receiving the valid dossier as prescribed, the Ministry of Science and Technology shall organize the appraisal of the program as prescribed and send the appraisal report as prescribed to the proposing agency. Within 15 days from the date of receiving the appraisal report, the proposing agency shall be responsible for completing the dossier and issuing the program as prescribed.

Regarding the appraisal and approval of special national science, technology and innovation programs; national science, technology and innovation programs for strategic technology development: Within 60 days from the date of receiving valid dossiers as prescribed, the Ministry of Science and Technology shall organize the appraisal of the program as prescribed and send the appraisal report to the proposing agency. Within 15 days from the date of receiving the appraisal report, the proposing agency shall be responsible for preparing an explanatory report, receiving appraisal opinions, completing the program appraisal dossier and sending it to the Ministry of Science and Technology.

Within 15 days from the date of receiving the explanatory report and accepting the appraisal opinions, the Ministry of Science and Technology shall preside over and coordinate with the proposing agency and relevant agencies to submit to the Prime Minister for consideration and approval of the special national science, technology and innovation program, the national science, technology and innovation program for strategic technology development according to regulations. After the program is approved, the proposing agencies assigned to preside over the program management and implementation organization shall report to the Ministry of Science and Technology on the program implementation status before December 15 every year.

Regarding the order and procedures for developing, promulgating, managing and organizing the implementation of science, technology and innovation programs of ministries, ministerial-level agencies, government agencies, other central agencies and provincial People's Committees, the agencies proposing to develop the program shall send them to ministries, ministerial-level agencies, government agencies, other central agencies and provincial People's Committees under their management for consideration and approval.

Within 60 days from the date of receiving valid proposals, ministries, ministerial-level agencies, government agencies, other central agencies and provincial People's Committees shall issue the program. The agencies shall then organize the implementation of the program and report to the Ministry of Science and Technology on the implementation status of the program before December 15 every year.

Decentralization of management of science, technology and innovation activities

1. According to management requirements, ministries, ministerial-level agencies and provincial People's Committees shall proactively decentralize to affiliated agencies and organizations to manage science, technology and innovation activities in accordance with the provisions of the Law on Organization of Government and the Law on Organization of Local Government.

2. The Ministry of Science and Technology decentralizes the management of science, technology and innovation activities to agencies and organizations under the Ministry of Science and Technology as follows:

a) The Ministry Office is the agency managing science, technology and innovation tasks for internal science, technology and innovation tasks and science, technology and innovation programs of the Ministry of Science and Technology;

b) The National Fund for Science and Technology Development is the agency managing science, technology and innovation tasks for science, technology and innovation tasks, science, technology and innovation programs for scientific research and technology development sponsored and ordered by the Ministry of Science and Technology, except for the case specified in Point a above.

c) The National Technology Innovation Fund is the agency managing science, technology and innovation tasks for science, technology and innovation tasks, science, technology and innovation programs for technology application, technology transfer, technology innovation, and innovation sponsored and ordered by the Ministry of Science and Technology, except for the case specified in Point a above.

3. Monitoring and inspection of the implementation of tasks and powers delegated in Clause 2 above shall be carried out as follows:

The units responsible for advising and assisting the Minister of Science and Technology in the state management of scientific research and technological development activities shall monitor and inspect the implementation of the regulations in points a and b of clause 2 above, corresponding to their assigned functions and tasks.

The unit has the function of advising and assisting the Minister of Science and Technology in state management of innovation activities, monitoring and inspecting the implementation of the provisions at Point a and Point c, Clause 2 above according to assigned functions and tasks.
