Court rejects Trump's request

According to ABC News, former President Trump's lawyers on August 29 asked a federal court in New York to transfer the case from state court to federal court.

A day later, the court ruled against the former president's request, saying it was "flawed." The case was returned in part because the lawyers failed to attach a written permission from the court or the prosecutor.

Sentencing for Mr. Trump in the New York case is scheduled for September 18.

The above effort by Mr. Trump's side is believed to be a tactic to delay the sentencing hearing scheduled to take place on September 18.

In a separate letter to Judge Juan Merchant, presiding over the case, Mr. Trump’s lawyers announced their intention to move the case to federal court and urged Mr. Merchant to postpone the sentencing.

Attorneys Todd Blanche and Emil Bove argued that there was no justifiable reason to sentence Mr. Trump before the November 5 presidential election.

In May, Mr. Trump was found guilty of 34 counts of falsifying business records to conceal payments to adult film actress Stormy Daniels. The payments were made before the 2016 election, allegedly to conceal his previous relationship with the actress. Prosecutors alleged that the defendant's actions influenced the election. Mr. Trump has said he will appeal.

Mr Trump's lawyers argue that the former president's recent re-indictment in the election interference case suggests the New York conviction should also be dismissed based on presidential immunity.

Special prosecutor Jack Smith on August 27 indicted Mr. Trump in a new indictment amended after the Supreme Court ruled that the defendant enjoys immunity from prosecution related to official actions while president.
