Specifically, the minimum area for land subdivision in all wards is 40m2 and 60m2 for communes. For non- agricultural land other than residential land, the minimum area for subdivision in all wards and communes is 80m2. For perennial crop land, the minimum area for subdivision in wards is 150m2 and 300m2 for communes. For other annual crop land, forestry land, aquaculture land, concentrated livestock farming land, salt production land, and other agricultural land, the minimum area for subdivision in all wards and communes is 500m2; for rice paddy land, the minimum area for subdivision is 1,000m2 for all wards and communes. If the subdivided plot does not meet the minimum area requirements, the procedure will only be processed if the plot is simultaneously merged with an adjacent plot.
In addition to the area requirement, the subdivided plot of land must meet requirements regarding shape and infrastructure. Accordingly, the width and depth of the plot must be 4 meters or more. For residential land, the subdivided plot must be adjacent to a public road. If it does not directly adjoin a road, the land user will only be considered for subdivision after simultaneously merging with an adjacent plot to ensure that it meets the adjacent road requirements as stipulated…
According to the City People's Committee, the issuance of the new regulations aims to concretize the authority of the locality in land management, while limiting the situation of fragmented land subdivision and spontaneous plot allocation that puts pressure on infrastructure and urban management.
