According to the Ho Chi Minh City Department of Education and Training, the new regulations aim to improve the legal framework and more effectively manage extracurricular tutoring, a topic that has sparked much debate among the public. The consultation process will be completed before October 31, 2025.

The draft consists of 5 chapters and 10 articles. Chapter I specifies the scope of regulation and the subjects of application; Chapter II clarifies the responsibilities of agencies in managing extracurricular tutoring activities; Chapter III regulates the management and use of funds; Chapter IV deals with inspection, examination, and handling of violations; and Chapter V concerns implementation.

A notable point in this draft is the proposed public disclosure of the list of students attending supplementary classes. Accordingly, supplementary education centers must manage, maintain, and readily present, upon request for inspection, all relevant documents, including: business registration license; subjects offered as supplementary classes, duration of each subject, and teaching schedule; list of teachers and students attending supplementary classes; timetables, application forms for supplementary classes, and tuition fees.

Furthermore, the draft no longer mentions prohibiting tutoring after 8 PM, as was previously the case.

Ho Chi Minh City also clearly defines responsibilities between the Department of Education and Training, relevant departments and agencies, the People's Committees at the commune/ward level, school principals, and tutoring centers. Each party has a specific role in guiding, inspecting, and supervising tutoring activities to ensure they comply with regulations, minimize negative practices, and create a fair and healthy educational environment.
