
Accordingly, the Council unanimously agreed with the proposal of the Ho Chi Minh City Department of Agriculture and Environment in Report No. 14477 and Official Letter No. 15055 regarding the initial appraisal of land price lists and their application from January 1, 2026.
The Council assigns the Department of Agriculture and Environment to finalize the draft land price list based on legal regulations, the opinions of the Council members, and the People's Committees of communes, wards, and special zones, and to complete all necessary documents and procedures to report to the Ho Chi Minh City People's Committee for submission to the Ho Chi Minh City People's Council for consideration and decision.
The report also noted numerous comments and criticisms from organizations, departments, and experts, which the Department of Agriculture and Environment has addressed, incorporated, and refined into the draft.
According to the Council, the land price list is constructed in accordance with certain principles. Specifically, the land valuation method follows market principles; adheres strictly to the methods, procedures, and processes of land valuation; ensures honesty, objectivity, openness, and transparency; guarantees the independence of the consulting organization determining the land price; and ensures a balance of interests between the State, land users, and investors.
For residential land, the Department of Agriculture and Environment collects land price information from price databases, market land transfer prices, incorporates feedback from localities, and bases its proposals on the actual socio -economic situation of Ho Chi Minh City to develop a land price list for residential land suitable for each ward, commune, and special zone. Simultaneously, it has reviewed and balanced price levels for areas bordering different localities and for road sections and routes within the same area.

Regarding commercial and service land, in Report No. 14477, the Department of Agriculture and Environment developed a land price list for commercial and service land based on an assessment of the socio-economic development characteristics of each area to propose appropriate prices for each area and location.
For non- agricultural production and business land that is not commercial or service land, the Department of Agriculture and Environment has assessed the socio-economic development characteristics of each area to propose appropriate land prices for non-agricultural production and business land.
Based on that, the Department of Agriculture and Environment has proposed that land prices for non-agricultural production and business land, excluding commercial and service land, with low building density and low land use coefficient, are appropriate.
Regarding agricultural land, in Report No. 14477, the Department of Agriculture and Environment developed a land price list for agricultural land based on an assessment of the socio-economic development characteristics of each area to propose appropriate prices for each area and location.
This also does not affect cases where the State reclaims land, because in such cases, the land owner will have the land price determined specifically according to market value to calculate compensation. At the same time, the Department of Agriculture and Environment has developed a land price list for agricultural land in the High-Tech Agricultural Zone, maintaining the current rates as appropriate.
At the meeting on December 9th, the Council requested the Department of Agriculture and Environment to coordinate the implementation of land valuation, review and supplement the income method for determining agricultural land prices, as a basis for verification, comparison, and proposal in accordance with regulations.
In Official Letter No. 15055, the Department of Agriculture and Environment explained the reason for not applying the income method according to Article 5 of Decree No. 71 to propose agricultural land prices: agricultural land in many areas of Ho Chi Minh City is no longer purely for agriculture, therefore it does not yield efficiency or yields very low income from agricultural cultivation, except for areas planned as agricultural land or agricultural reserve land.
Therefore, the income-based method does not fully reflect market value. Regarding this matter, the Council unanimously agreed with the feedback and explanation provided by the Department of Agriculture and Environment.
Vice Chairman of the Ho Chi Minh City People's Committee, Bui Minh Thanh, acknowledged the efforts and highly appreciated the sense of responsibility of the Department of Agriculture and Environment in focusing maximum resources on developing the initial land price list. Through discussions and feedback from Council members, the Department of Agriculture and Environment selectively incorporated and explained the contents.
