According to Government Decree No. 90/2023/ND-CP regulating the rates, collection, payment, exemption, management, and use of road usage fees (also known as road tolls), the subjects liable for road usage fees are registered motorized road vehicles (with vehicle registration certificates and license plates), inspected for circulation - and issued with technical safety and environmental protection certificates, including cars, tractor-trailers, and similar vehicles (cars).
However, cars will not be charged road usage fees if they fall into one of the following categories:
- Destroyed due to accidents or natural disasters.
- The vehicle registration certificate and license plates have been confiscated or revoked.
- Injured to the point that the vehicle cannot continue to operate and requires repairs lasting 30 days or more.
- Vehicles used for transportation business belonging to enterprises, cooperatives, or cooperative unions engaged in transportation business (enterprises) that have been temporarily suspended from operation for 30 consecutive days or more.
- Vehicles owned by businesses that do not participate in traffic or use roads belonging to the road transport system (only issued inspection certificates and not inspection stickers according to the regulations on technical safety and environmental protection inspection of road motor vehicles of the Ministry of Transport ) or vehicles that are currently participating in traffic and using roads belonging to the road transport system (already issued inspection certificates and inspection stickers according to the regulations on technical safety and environmental protection inspection) are transitioned to not participating in traffic or using roads belonging to the transport system, only being used within the following areas: driving test centers; train stations; ports; mining areas; agricultural, forestry, and aquatic product cultivation, production, and processing areas; construction sites (transportation, irrigation, energy).
- Vehicles registered and inspected in Vietnam but operating abroad continuously for 30 days or more.
- The vehicle has been stolen for 30 days or more.
The above-mentioned cases are exempt from road usage fees if they have sufficient documentation to meet the requirements of Article 8 of Decree 90/2023/ND-CP.
If the vehicle has already paid the road usage fee, the owner will be reimbursed the amount paid or the amount will be deducted from the fee payable in the next period, corresponding to the period of non-use of the road as stipulated. This does not apply to vehicles of the national defense and police forces.
Meanwhile, according to current regulations in Circular 70/2021/TT-BTC, vehicles such as cars, tractor-trailers, and similar vehicles are exempt from road usage fees in the following cases:
Damaged due to accident or natural disaster; Confiscated or revoked vehicle registration certificate and license plates; Injured in an accident to the point that it cannot continue to operate and requires repairs for 30 days or more;
Vehicles used for commercial transport by enterprises, cooperatives, or cooperative unions engaged in transport business that have been temporarily suspended from operation for 30 consecutive days or more;
The company's vehicles do not participate in traffic, do not use roads belonging to the road transport system, and are only used within the premises of the driving test center, train station, port, mining area, agricultural, forestry, and fishery areas, and construction sites (transportation, irrigation, energy).
Vehicles registered and inspected in Vietnam but operating abroad continuously for 30 days or more; Vehicles stolen for 30 days or more.
