On the afternoon of June 17, the National Assembly listened to the Presentation and the Verification Report on the draft Law on Notarization (amended). At the meeting, according to Deputy Prime Minister and Minister of Justice Le Thanh Long, the draft Law on Notarization (amended) consists of 10 chapters and 78 articles, built on the basis of maintaining 9 articles, amending 61 articles, reducing 12 articles and adding 9 new articles out of a total of 81 articles of the 2014 Law on Notarization.
Compared with the 2014 Notary Law, the draft Law has been amended and supplemented with provisions on a number of prohibited acts for civil servants (CCV), notary practice organizations (TCHNCC), individuals and related organizations to improve the quality of the CCV team, contribute to the development of stable and sustainable TCHNCC, and enhance the responsibility and awareness of individuals and organizations related to notarization.
In order to improve the quality of the CCV team, ensure the quantity is suitable for the notary needs and develop stably and sustainably, compared to the 2014 Notary Law, the draft Law has been amended and supplemented with the regulation that those who want to be appointed CCV must be trained in the notary profession. Accordingly, those who are exempted from training and participate in a 3-month training course according to the provisions of the current Law must participate in a 6-month training course. Some subjects are added to be allowed to attend a 6-month notary training course such as intermediate enforcement officers, chief inspectors of the prosecution, class II legal assistants, chief inspectors of the judiciary.
In addition, the regulation on the internship period for notary practice is 12 months for all subjects to ensure consistency and to give trainees enough time to experience and apply the knowledge and skills they have learned into practice; trainees must ensure the internship period according to the working days and hours of TCHNCC. Supplementing regulations on the validity period of the internship results test certificate to ensure that the person appointed as CCV has updated knowledge and skills.
Also according to Mr. Long, the draft Law stipulates that the age for practicing notaries is up to 70 years old. At the same time, the draft Law stipulates that notaries over 70 years old who are practicing notary at the time this Law comes into effect can continue to practice notary for a maximum period of 2 years to ensure the process of transferring the activities of these notaries.
Reviewing the draft Law, Mr. Hoang Thanh Tung, Chairman of the National Assembly's Law Committee, said that the Law Committee approved the comprehensive amendment of the Law on Notarization. In addition, he requested the drafting agency to continue reviewing to legalize as much of the contents currently stipulated in sub-law documents as are clear, have been tested in practice and have proven effective in practice.
Mr. Tung also proposed to fully assess the impact of administrative procedures in the draft Law to cut and simplify unnecessary administrative procedures that increase compliance costs, thereby contributing to improving the investment and business environment and promoting socio -economic development.
