Strictly handle violations in social housing projects in Dak Nong (old)

On December 5, Lam Dong Provincial Inspectorate announced that the unit had just issued the conclusion of the inspection of the social housing project in Nam Gia Nghia ward, Lam Dong province.

This is the only social housing project to date being implemented in the western region of Lam Dong province, namely the old Dak Nong province.

Accordingly, Lam Dong Provincial Inspectorate proposed that Lam Dong Provincial People's Committee direct strict handling of violations by relevant units, and at the same time transfer information to the Provincial Police to investigate and handle acts related to buying and selling houses to the wrong subjects and accepting fake volumes to borrow capital from banks.

According to the Lam Dong Provincial Inspectorate, the social housing project in Nam Gia Nghia Ward, Lam Dong Province was implemented on an area of ​​nearly 18,000 m2 and was granted the first investment policy in February 2017. However, the project's location is not consistent with the approved master plans; the construction permit granted for the project in August 2028 was also determined to be inconsistent with the detailed 1/500 planning of this area...

In addition, the inspection agency determined that the project investor did not construct in accordance with the design documents and construction permits issued. The investor also handed over the houses to households to move in when the project had not been accepted and the technical infrastructure works (such as roads, electricity, water, etc.) were not completed and not connected to the infrastructure of the area. The majority of households also illegally built and expanded many items after the houses were handed over...

More notably, the inspection agency determined that the investor had mobilized more than 96 billion VND from 106 individuals, but most of these contracts were determined to be illegal. The acceptance of the project's construction volume as a basis for disbursing bank loans was also determined to have many illegal items, violating regulations on construction quality management and legal regulations on invoices and documents...

According to the Lam Dong Provincial Inspectorate, the investor has transacted to sell houses in the project to 106 cases, but only 7 cases have been assessed and determined to be eligible, the remaining 99 cases have been determined to be ineligible or have not been assessed by the competent authority.

Regarding the detection and handling of violations and mistakes during the project implementation process of the investor, some functional departments of the old Dak Nong province were also determined to have not performed properly. Typically, in June 2022, functional departments determined that the investor had 5 administrative violations during the project implementation process, including: real estate business without ensuring full conditions; handing over houses to customers when infrastructure investment had not been completed and acceptance had not been carried out; mobilizing capital in violation of regulations; not reporting the project implementation status and selling and leasing social housing without ensuring the conditions as prescribed.

However, the Department of Construction only penalized one act of selling or renting social housing that did not meet the prescribed conditions, and did not penalize the remaining four acts nor advise the competent authority (the Provincial People's Committee) to penalize them according to the regulations.

Based on the inspection results, the Chief Inspector of Lam Dong province recommended that the People's Committee of Lam Dong province direct the Department of Construction to review violations and impose penalties, and advise on penalties according to regulations. At the same time, strictly implement measures to force investors to remedy the consequences in order to completely resolve the existing problems and violations of the project and handle the responsibilities of related individuals and groups.

In addition, Lam Dong Provincial Inspectorate also recommended that the Provincial People's Committee direct Lam Dong Provincial Tax Department to review the project's land use fee exemption records as well as the value added tax refund; assign the Provincial Inspectorate to transfer information to the Investigation Police Agency and Lam Dong Provincial Police to verify and handle 2 contents with signs of crime, including: the investor selling social housing and mobilizing capital from 99 cases that did not meet the conditions or had not been appraised and the issuance and use of 4 illegal invoices (total value of more than 96 billion VND) as a basis for disbursing bank credit capital.

The social housing project in Nam Gia Nghia ward, Lam Dong province was first granted investment policy to Beton 6 Traffic Construction Joint Stock Company in February 2017 and transferred to ESG Vietland LLC in 2018. After that, the project was extended many times in 2019, 2020, 2021... but until now it has not been completed.
